The purpose of this Invitation for Bid is to establish a contract, by means of sealed bids, with a qualified contractor, for Permitting, Silt, Sediment and Debris Removal for the Center Channel Inlet Area of Baker Park, City of Frederick. The Bidder agrees to pay the City liquidated damages in the amount of $500 per calendar day beyond the required Substantial Completion date. The Bidder or City, respectively, shall not be liable for any loss or damage, resulting from any delay or failure to perform its contractual obligations within the time specified, due to acts of God, actions or regulations by any governmental entity or representative, strikes or other labor trouble, fire, embargoes, or other transportation delays, damage to or destruction in whole or in part, of equipment or manufacturing plant, lack of or ability to obtain raw materials, labor, fuel or supplies for any reason including default of suppliers, or any other causes, contingencies or circumstances not subject to the Bidder's or City's control, respectively, whether of a similar or dissimilar nature, which prevent or hinder the performance of the Bidder's or City's contractual obligations, respectively. The City may accept or reject, in whole or in part, for any reason whatsoever any or all submissions; re-advertise this Solicitation; postpone or cancel at any time this Solicitation process when it is in the best interest of the City to do so.
