The issue is back on the agenda and County Judge Dustin Fawcett said the current cemetery is out of room and he believes counties have the authority to expand existing cemeteries. He also defends the expansion, which if not torpedoed during Tuesday’s meeting, will be out near the Ector County Detention Center. Fawcett also said the cemetery is one of the few places counties can make a profit and that the need is there as the county is responsible for burial of paupers and veterans. He also said this expansion would be done with ARPA funds from the federal government. He said part of the issue with the Tuesday agenda item is that some want to ask the state for permission to move forward. “I will not vote to ask for permission from the state on how to run our County,” Fawcett said. “We hear from more constituents on this topic (expanding the cemetery) than any other topic. We believe we have the authority to expand.” He said he also got an opinion from the Texas Association of Counties that expanding is acceptable. “Texas Statute allows Ector County to ‘maintain’ our current historic cemetery. There is limited abilities of the county, but we have argued, that in order to ‘maintain’ providing this service to citizens, an expansion is needed. We are expanding our current historical cemetery on new grounds. A county that does not have a historical cemetery, that just decides to get into the cemetery business, does not have authority to build one new,” Fawcett said. “That is one facet. The other facet is that the County does have explicit authority to build or expand on a cemetery for the purposes of Veteran and Pauper burials,” he added.
