Renovation of a mixed-use development in Albany, New York. Completed plans call for the renovation of a transportation facility.
Please submit final questions/requests by close of business Wednesday May 6, 2020. Pursuant to the State of New York Executive Order 202.6 NYS on PAUSE related to COVID-19, Empire State Development has provided clarification to the order and has indicated that this project is an Essential Project and can proceed following proper social distancing protocals/procedures. Albany Port District Commission (APDC) invites the submission of Separate Sealed Bid Proposals to furnish materials & labor to complete the Port of Albany Maritime Warehouse and Related Maritime Terminal Improvements, in accordance with the plans & specifications for the following categories of work: Contract #1 - General Work Contractor (GWC) In a case where there are duplicate emails received from the same firm, the most recent complete package received prior to the bid time will be treated as the submitted bid. Hard copies of bid documents for the apparent low and second low bidders within each contract are to be provided to Port of Albany, 106 Smith Boulevard, Albany, NY 12202 within 18 hours of the bid. The Albany Port District Commission (APDC) reserves the right to reject any and all bids received and to waive any technical informalities within the specifications. No bidder may withdraw his bid within 45 days after the actual date of the opening thereof. Any bid may be withdrawn without prejudice prior to the official bid opening time or any publicized postponement thereof. Any bid received after the time and date stated above will be returned unopened. Starting at 1pm Friday, April 10th, 2020 Documents are available in the four (4) following medians through the printer Dataflow, (albany@goDataflow.com) 71 Fuller Road, Albany, NY 12205 P-518-463-2192, additionally to avoid shipping costs full sized plans and specs as well as CD's will be available at all six (6) New York Branches of Dataflow, including Albany, Binghamton, Corning, Ithaca, Utica, and Rochester: (1) Digital Viewing - Bidders may register to view the CONTRACT DOCUMENTS, online free of charge, on our project portal by visiting ; click Find Projects; under Register Projects, click APDC - Warehouse click Register Now to obtain a valid username and password. (2) Digital Download -Digital Download of Project documents are available through the project portal (See #1 above) for a fee of $25.00 payable directly to the printer (Credit Cards payments are preferable); an instruction sheet for ordering the PDF Download has been included as a link within the portal (3) CD Containing Plans and Specs - Compact disks containing the plans and specs may be purchased for $15.00 each by prospective bidders directly from the Printer (Checks or Credit Cards are Acceptable) + Shipping costs as may be necessary should be arranged with the printer and are non-refundable. (4) Shipping costs as may be necessary should be arranged with the printer directly and are non-refundable. Drawings and specifications remain the property of the Owner and must be returned to the Printer. Additional hard bid documents will be available for purchase at actual cost of reproduction. Based on the current pandemic NO Prebid Site Meeting will be held, but the following opportunities are available for reviewing the project: a video of a drone flyover along with still images will be made available to all bidders. A majority of the site can be seen clearly from the street without entry to the site. We will review the need to visit the site after bidders have reviewed the documents including the video and still images prior to scheduling ANY site visits. At all times Social Distrancing is essential. Interested Bidders are Strongly Urged to make themselves familiar with the information provided and review the surrounding conditions as are evident from the street. Plan houses that are typically utilized for viewing hard copies of contract documents are currently closed. At ths time the options for review are the modalities available through Data Flow. It is the policy of the APDC to encourage minority- and wormen-owned business enterprise participation in ths project by contractors, subcontractor and suppliers under the Contract, and all bidders are expected to cooperate in implementing this policy. APDC hereby establishes an overall goal of 30% for MWBE partiticipation, 15% for Minority-Owned Buisiness Enterprises (MBE) participation and 15% for Women-Owned Business Enterprises (WBE) participation. Based on the federal funding source provided for the this project the work carried out by the Contract #1 General Work Contractor (GWC) does not require a goal. This contractor is to provide best effort and documentation of same. It is the policy of the APDC to encourage Sevice-Disableed Venteran-Owned Business participation in projects by contractors, subcontractors and suppliers, and all Bidders/Contractors are expected to cooperate in implementing this policy. The participation goal for all contracts is 6% utilization. Pursuant to New York State Finance Law 139-j and 139-k, this request for proposals (RFP) includes and imposes certain restrictions on communication between a Governmental Entity (APDC and any other government entity) and an Offerer/Bidder during the procurement process. An Offerer/Bidder is restricted from making contacts from the earliest notice of intent to solicit offers through final award and approval of the Procurement Contract by the APDC and, if applicable, Office of the State Comptroller (restricted period) to other than designated staff unless it is a contact that is included among certain statutory exceptions set forth in State Finance Law 139-j (3) (a). The designated contactee for this RFP is Megan Daly, Director of Economic Development & Procurement, APDC (Mdaly@portofalbany.us) and Mike Delima, Project Executive, BBL Construction Services (mdelima@bblinc.com) who is the designated project Construction Manager Advisor. Governmental Entity employees are also required to obtain certain information when contacted during the restricted period and make a determination of the responsibility of the Offerer/bidder pursuant to these two statutes. Certain findings of non-responsibility can result in rejection for a contract award and in the event of two findings within a four year period, the Offerer/bidder is debarred from obtaining governmental Procurement Contracts. Further information about these requirements can be found in the appropriate statutes and on the New York State Office of General Services website under the link for the Advisory Council on Procurement Lobbying. Additionally, the above referenced laws (and other laws) require certain affirmations/certifications to be provided to the APDC by bidders and that certain provisions are contained within any contract/award resulting from this RFP. The Owner reserves the right to reject any or all bids and to waive any informalities or defects in such bid either before or after opening. Each bidder must deposit with his bid, security in the form and subject to the conditions provided in the "INSTRUCTIONS TO BIDDERS". Attention of bidders is particularly called to the requirements as to conditions of employment to be observed and to the minimum wage rates to be paid under the contracts.
