To offset such loss, the Contractor and the Contractor's Surety shall be liable for and shall pay the Owner One Thousand Dollars ($1,000.00) for each day the Work remains incomplete in excess of time allotted for Substantial Completion. Such amount shall be paid to the Owner as liquidated damages, not as penalty, and shall be included in the Agreement between Owner and Contractor.
