Bidders are required to submit a Bid guarantee in the amount of 5% of the total Bid amount in accordance with the IFB. No Bid may be withdrawn for a period of one hundred twenty (120) days after Bid opening. The Contract to be entered into pursuant to this NOTICE INVITING BIDS may be subject to financial assistance Contract between RTD and the United States Department of Transportation. If this Bid is subject to Federal financial assistance, and for any reason the Federal financial assistance is withdrawn, then and in such event RTD may withdraw this NOTICE INVITING BIDS and/or terminate any Contract entered into in accordance with this IFB. It is the policy of the U.S. Department of Transportation that Disadvantaged Business Enterprises (DBEs), as defined in 49 CFR Part 26, shall be encouraged to participate in the performance of Contracts financed in whole or in part with federal funds. As a condition of federal grant assistance, RTD has adopted a DBE program for RTD's federally funded Contracts. No DBE goal has been established for this project. However, Bidders shall ensure that DBEs have the opportunity to participate in the performance of this Contract and shall take all necessary and reasonable steps to obtain DBE participation. Contractor shall not discriminate on the basis of race, color, national origin, sex, disability, or age in the award and performance of subcontracts. RTD also encourages the participation of certified Small Business Enterprises (SBE) on all of its procurement activities. At all times RTD promotes small business participation, by establishing and maintaining a plan that will assist small business competition, eliminate any obstacles that may prevent their participation as prime contractors or as subcontractors. Pursuant to the California State Licensing Board, at the time of submitting bids, Bidders must be in possession of a valid California State Contractor's License Classification: B General Building, C-7 Low Voltage Systems, or C-10 General Electrical. The successful Bidder, and each of its subcontractors, shall be required to comply with all local, state and federal labor laws and regulations. They shall be required to pay the local prevailing rate of per diem wages as established by the Director of the California Department of Industrial Relations or the prevailing wages as established by the Secretary of Labor of the United States, whichever is higher. Copies of said wage rates are on file at the office of RTD, and shall be made available to any interested party, upon request. A Performance Bond is required for Contracts over $100,000.00. A Payment Bond is required for Contracts over $25,000.00. In accordance with the provisions of Section 22300 of the Public Contract Code, Contractor may elect to receive 100% of payments due under the Contract, without retention of any portion of the payment, by entering into an Escrow Agreement for Security Deposits in Lieu of Retention. All Bidders are required to read and completely familiarize themselves with the terms and conditions of the IFB, and to submit all necessary paperwork as required of Bidder as specified in this IFB. RTD reserves the right to postpone Bid opening, accept or reject any and all Bids and to waive any informality in any Bid, as RTD deems to be in its own best interests and subject to the rules and regulations issued by the Federal Transit Administration of the United States Department of Transportation.
