Site work and paving for a mixed-use development in Marshalltown, Iowa. Completed plans call for site work for a sidewalk / parking lot; for paving for a sidewalk / parking lot; and water / sewer project.

Each proposal must be accompanied either by a cashier's check or certified check in the amount of five percent (5%) drawn on an Iowa bank or a bank chartered under the laws of the United States, a Bid Bond or credit union certified share draft in the amount of five percent (5%) of the proposal, drawn on a credit union in Iowa or chartered under the laws of the United States and filed in an envelope separate from the one containing the proposal, made payable to the City of Marshalltown, Iowa, and said check or draft may be cashed or the Bid Bond declared forfeited by the City of Marshalltown, Iowa as liquidated damages in the event the successful bidder fails to enter into a contract within fifteen (15) days of the Notice of Award and post bond satisfactory to the City insuring the faithful fulfillment of the contract and maintenance of said i Tiprovements as required by law and the Specifications. A pre-bid conference will not be held. Payment to the Contractor for said construction will be made in cash from the following sources: Cash from any fund of City of Marshalltown, Iowa, which may be legally used for such purposes; proceeds derived from the sale and issuance of Utility Revenue Bonds, or Federal or State grants or loans. The Contractor will be paid each month Ninety-five Percent (95%) of the Engineer's Estimate of the value of work completed at the end of the preceding month. Final payment will be made no sooner than thirty (30) days after completion of the work and acceptance by the Owner. Work under the proposed contract shall commence within thirty (30) days of the written "Notice to Proceed." Phase 1 work shall be substantially completed by May 31, 2019. Phase 2 work under the proposed contract shall not commence until after Phase 1 work is completed and shall be substantially completed by September 27, 2019. Phase 3 work under the proposed contract shall not commence until after Phase 2 work is completed and shall be substantially completed by October 25, 2019. Phase 4 work under the proposed contract shall not commence until after Phase 3 work is completed and shall be substantially completed by November 29, 2019. Phase 5 work under the proposed contract shall not commence until after Phase 4 work is completed and shall be substantially completed by March 20, 2020. Phase 6 work under the proposed contract shall not commence until after Phase 5 work is completed and shall be substantially completed by April 17, 2020. Phase 7 work under the proposed contract shall not commence until after Phase 6 work is completed and shall be substantially completed by May 22, 2020. Phase 8 work under the proposed contract shall not commence until after Phase 7 work is completed, shall include all project areas including areas with easements and within UP Railroad R/W, and shall be substantially completed by June 26, 2020. Final completion for all phases shall be by July 31, 2020 Owner. Project Phasing shall be as per the areas indicated on Sheets D1.0, D1.1, and D1.2, and as indicated on the drawings. The project area phasing shall include all work within the phasing work areas indicated on the plans. The Owner and Contractor recognize that time is of the essence of this Agreement and that City will suffer financial loss if the Work is not completed within the times specified in paragraph above, plus any extensions thereof allowed. They also recognize the delays, expense and difficulties involved in proving in a legal proceeding the actual loss suffered by City if the Work is not completed on time. Accordingly, instead of requiring any such proof, City and Contractor agree that as liquidated damages for delay (but not as a penalty) Contractor shall pay the City of Marshalltown $1,375.00 for each day-that expires after the time specified for Substantial Completion for the contract until the work is certified by the Engineers substantially complete and $500.00 for each day after the time specified for certification of Final Completion if Contractor neglects, refuses or fails to complete the remaining Work within the contract time for Final Completion. The City shall deduct the accrued liquidated damages from the final payment due to the Contractor. All proposals shall be made upon the official bidding blanks furnished by the City and any alteration in the Official Form of Proposal will entitle the Council, at its option, to reject the proposal involved from consideration. Each said proposal shall be sealed and plainly identified. The successful bidder shall furnish the City a surety bond, acceptable to said City, for one hundred percent of the bid guaranteeing his faithful performance of the contract. All bonds called for in this notice shall contain no other conditions except as provided in Chapter 384.97(5) of the Iowa Code. Preference will be given to products and provisions grown and coal produced within the State of Iowa, by virtue of statutory authority, and to Iowa domestic labor in constructing said improvements. The Contractor shall file with the contract a corporate surety bond acceptable to the City and providing for maintenance of the improvements for not less than four (4) years from and after acceptance of the project. The Owner reserves the right to defer acceptance of any proposal for a period not to exceed forty-five (45) days from the date of receipt of proposals. The City Council reserves the right to reject any and all bids and to waive technicalities and irregularities and all bids must remain effective for a period of 45 days of opening same. Contractor shall complete all Work as specified or indicated in the Contract Documents. The Work is generally described as follows: Sanitary sewer improvements shall include, but not be limited to approximately 111 manholes, 714 LF of 8-inch through 24-inch sanitary sewer, 6,000 SY of pavement removal and replacement, 33,965 LF of sanitary sewer televising pre and post construction inspection televising, 161 LF of sanitary sewer cured-in-place point repairs, curb and gutter removal and replacement, PCC sidewalk removal and replacement, PCC driveway removal and replacement, 571 LF of water main relocation, seeding, and associated other work for construction.
