The Project is located at various citywide locations, and is described as follows: traffic control, public notifications, weed removal, cleaning pavement cracks, sealing pavement cracks with rubberized crack sealant and mastic sealant and other related works. Requests for information, and requests for clarification regarding the Project, the bid procedures, or any of the Contract Documents must be submitted to City in writing, addressed to the Project Manager for the Project, as follows:Edward Nakayama, Senior Civil Engineer 39550 Liberty Street, Fremont, CA 94538. enakayama@fremont.gov If a bidder finds any error, omission, inconsistency, or ambiguity in the Contract Documents, the bidder must make a written request for clarification before submitting the bid.Bidders must submit any inquiry under this Section by 2:00p.m.atleast 4 Working Days before the Bid Deadline. Questions received any later will not be addressed before the Bid Deadline. All data substantiating the proposed substitute as an equal item must be submitted with the written request for substitution. Pre-bid requests for substitution must be submitted to the Engineer at least seven Working Days before the Bid Deadline, so that all interested bidders may be notified of any approved alternative. Any other requests for substitution must comply with the General Conditions. If the Engineer denies the request for substitution, the material, product, thing or service specified in the Contract Documents must be furnished and installed. This provision does not apply to materials, products, things, or services that may lawfully be designated by a specific brand or trade name under Public Contract Code Section 3400(c) and Fremont Municipal Code. City reserves the right, acting in its sole discretion, to waive nonmaterial and inconsequential bid irregularities, to accept or reject any and allbids, to issue a new Notice Inviting Bids for the Project,or to abandon the Project entirely. City reserves the right to award the Contract to the bidder it has determined to be the responsible bidder submitting the lowest responsive bid, and to issue a Notice to Proceed with the Work notwithstanding any pending or continuing challenge to its determination.
