This project involves supplying tri-axle vehicles with drivers for the trucking/hauling of materials, equipment, supplies, etc. for the benefit of the Township of Warminster. Prevailing wages shall be compliant with the U.S. Department of Labor Prevailing Wage Resource Book. For example, prevailing wage rates do not apply for time spent off the site of the work or for time spent on the site of the work that is considered de minimis (e.g. only a few minutes at a time picking up or dropping off materials or supplies). Prevailing wage rates do apply for recordable amounts of time spent loading and/or unloading materials and supplies at the site of the work which is not considered de minimis. This project is subject to applicable provisions of Act 89, Transportation (74 PA.C.S.) and Vehicle Code (75 PA.C.S.) Omnibus Amendments and applicable provisions of Act 422, Pennsylvania Prevailing Wage Act, as amended, and the prevailing minimum wage rates issued by the Pennsylvania Department of Labor and Industry when the contract is valued at over Twenty Five Thousand Dollars ($25,000). A Bid may be modified or withdrawn by an appropriate document duly executed in the manner that a Bid must be executed and delivered to the place where Bids are to be submitted prior to the date and time for the opening of Bids. Bids may be withdrawn within two (2) business days after the opening of Bids only by the withdrawing Bidder's strict compliance with 73 P.S. 1602 and any subsequent amendments. No Bidder may withdraw his bid within sixty (60) days after the date set for the opening of the bids, or for such longer period of time that Bidder may agree to in writing upon request of Owner. The Township of Warminster reserves the right to reject any and all bids for any cause whatsoever, to eliminate any item or items from the contract, and to waive any informality in the bids The successful Bidder shall be required to furnish a performance bond for 10% of the amount of the contract, payment bond for 100% of the amount of the contract n such form as meets the approval of the Township of Warminster and having as security thereon such Surety company or companies as are approved by the Township of Warminster.
