Mt. San Antonio College of Los Angeles County, California, acting through its Governing Board of Trustees, hereinafter referred to as "District", shall receive bids. Each bid shall conform and be responsive to the bid documents. No bidder may withdraw his bid for a period of ninety (90) days after the date set for the opening of bids. Contractors wishing to bid as a prime contractor for this project must be pre-qualified by the District. Pre-qualification forms are available by contacting the purchasing department at (909) 274-4245. Each Bidder submitting a proposal to complete the work, labor, materials, and/or services ("Work") subject to this procurement must be registered with the Department of Industrial Relations pursuant to Labor Code A Bidder who is not a DIR Registered Contractor when submitting a proposal for the Work is deemed "not qualified" and the proposal of such a Bidder will be rejected for non-responsiveness. Pursuant to Labor Code 1725.5, all Subcontractors identified in a Bidder's Subcontractors' List shall also be DIR Registered Contractors. This project requires that the Contractor and any subcontractor(s) shall pay not less than the prevailing rates of wages to all workers employed by them in the execution of the contract. Copies of schedules of rates so determined are on file in the Purchasing Office and are available to any interested party upon request. Pursuant to Labor Code 1771.4(a)(4), Prevailing Wage Rate monitoring and enforcement shall be by the Department of Industrial Relations. In accordance with provisions of Public Contract Code Section 223000, substitution of eligible and equivalent securities for any monies withheld to ensure performance under this contract will be permitted at the request and expense of the Contractor. The District reserves the right: (1) to accept or reject any and all bids, (2) to waive any irregularities in the bids or bidding, (3) to be sole judge as to the merit, quality, and acceptability of materials proposed and their compliance to the specifications which in their opinion will best serve the interest of the District.
