Renovation of an educational facility in Reamstown, Pennsylvania. Completed plans call for the renovation of a educational facility.
The undersigned acknowledges that time of delivery is vital for the operation of schools, and is therefore "of the essence" in this contract and that upon any default by the undersigned in making delivery within the time specified in the Instructions to Bidders, you may obtain the supplies elsewhere and recover any loss from the undersigned. The undersigned also agrees to promptly remove and replace any rejected articles at no expense to you, and so as not to interfere with or delay your school operation.The undersigned, intending to be legally bound agrees (A) that his bid shall remain irrevocable and subject to acceptance for 120 days after bid opening date; and (B) that bid(s) for any one or more items may be accepted separately, and without regard to possible non-acceptance of other items bid on. The Cocalico School Board reserves the right to waive any informality, reject any or all bids.All bids shall be submitted in sealed envelopes marked:"Sealed Bid for Reamstown DHW Heater Replacement Bids must be typewritten or written in ink and must be signed by the bidder on the enclosed form. Unsigned bids will not be considered. Changes, alterations, or interlineations in the bid are not permitted. Bid figures shall include permit fees, inspection fees, and all charges including delivery at the destination called for in these specifications. The school district will complete Federal Excise Tax Exemption Certificates furnished by the vendor. The school district is exempt from State Sales Tax under the exemption number #76-36130-7. Delivery and installation shall be made at the destination called for within the time indicated on the bid, unless otherwise specified, or agreed by both the school board and the supplier/contractor.6.A Bid Security in the amount of 10% of the Base Bid shall be submitted with the Bid naming the owner as oblige. Bid Security shall be in the form of a Certified Check, Bank Cashier's Check, or a Bid Bond on a form provided by the Bidders and executed by a corporate surety qualified to do business in Pennsylvania. All Bidders shall contact Kurt Eckenroad, Director of Buildings and Grounds, (717) 336-1571, to set up a time to visit the site during Bid Period to see the extent of the work to be performed at each site.8.Bids shall be submitted on the basis of full and total compliance with local, Federal and Commonwealth laws, regulations, statutes and requirements pertaining to the project.9.In accordance with Act 34 enacted by the Pennsylvania Legislators, all employees of Contractors, their Subcontractors or Suppliers who come in contact with students during the work of the project shall be subject to screening by the Pennsylvania State Police to include Criminal History Information (Section 111 Of PA School Code of 1949), Child Abuse History (Act 151), if not a PA resident for past 2 years an FBI background check required, Act 114 of 2006 -Federal criminal history record. Each Prime Contractor shall provide completed forms for each employee on the job to the Owner prior to commencement of the work and shall pay all associated fees required for the investigation. Prospective Bidders are advised that this project is subject to and will be governed by provisions of Pennsylvania Prevailing Wage Act. Bidders shall prepare their bids after giving consideration to the applicability of said Pennsylvania Wage Act to the work involved, and to all other laws and regulations, State or Federal, applicable to the project. In the event that a Bid Bond is submitted with the Bid, the Attorney-in-Fact who executes the Bond on behalf of the Surety shall affix to the Bond a certified and current copy of the power of attorney, evidencing the authority of the agent of the surety to execute the Bid Bond. Failure to secure a Performance Bond and Insurance Certificates or to execute Contract within the specified time period shall constitute a default by the Bidder and the Owner may, at their sole discretion, award the Contract to the next lowest responsible Bidder or re-advertise for bids, and the defaulting Bidder shall pay to the Owner the difference between the amount of the Bid and any higher amount for which the Owner may contract for the required Work, plus any advertising or Architect fees, legal fees and other expenses incurred by reason of the default. The Bid Security of such defaulting Bidder or, as the case may be, the amount recovered from the Surety of such Bidder, shall be applied on account of said damages; and, if the amount of said difference,plus expenses, exceeds the amount of such Bid Security or recovery, the defaulting Bidder shall pay to the Owner the full amount of excess. Bid security checks will be returned to all except the three (3) lowest Bidders within ten (10) days after Bid opening, others returned within two (2) days after Owner signs a contract with successful Bidder, but in no event exceeding one hundred twenty (120) days after bid opening. No interest will be given for Bid Security checks held by Owner. The successful Bidder shall be responsible for getting all permits and all inspections necessary for the project. These permits and inspections shall be at the successful Bidders expense. Bids will be awarded at the School Board meeting on Monday, June 17, 2019. All work shall be completed between June 19, 2019 and August 19, 2019.
