Documents Accompanying Bid Proposal. Each Bid Proposal shall be accompanied by: (a) the required Bid Security; (b) Designation of Subcontractors; (c) Non-Collusion Declaration; (d) Contractor Certificate Regarding Workers Compensation; (e) DVBE Participation Statement; (f) Substitution Request Form; (g) Acknowledgment of Bidding Practices Regarding Indemnity; (h) Contractor's Certificate Regarding Drug-Free Work Place; and (i) Contractor's Certificate Regarding Alcoholic Beverage and Tobacco-Free Campus Policy. Prevailing Wage Rates and Labor Compliance Program. Pursuant to California Labor Code 1773, the Director of the Department of Industrial Relations of the State of California has determined the generally prevailing rates of wages in the locality in which the Work is to be performed. District incorporates all the provisions of the LCP. The successful bidder and each of its subcontractors of any tier will be required to pay not less than the general prevailing rates of per-diem wages and the general prevailing rate for holiday and overtime work in the locality in which the work is to be performed for each craft or type of worker needed to execute the contract, pursuant to sections 1770 et seq of the California Labor Code. Prevailing wage rates are available at online. Pursuant to Labor Code sections 1725.5 and 1771.1, all contractors and subcontractors that wish to bid on, be listed in a bid proposal, or enter into a contract to perform public work must be registered with the Department of Industrial Relations. No bid will be accepted nor any contract entered into without proof of the contractor's and subcontractors' current registration with the Department of Industrial Relations to perform public work. If awarded a Contract, the Bidder and its subcontractors, of any tier, shall maintain active registration with the Department of Industrial Relations for the duration of the Project. This Project is subject to compliance monitoring and enforcement by the Department of Industrial Relations. In bidding on this project, it shall be the Bidder's sole responsibility to evaluate and include the cost of complying with all labor compliance requirements under this contract and applicable law in its bid. Contractors License Classification. In accordance with the provisions of California Public Contract Code 3300, the District requires that Bidders possess the following classification(s) of California Contractors License at the time that the Contract for the Work is bid: license required: B, C8, C12, C27, C36, C42 As Applies to Scope of Work. Any Bidder not so duly and properly licensed shall be subject to all penalties imposed by law. Bid Security Each Bid Proposal shall be accompanied by Bid Security in an amount not less than ten percent (10%) of the maximum amount of the Bid Proposal, inclusive of any additive Alternate Bid Item(s). Failure of any Bid Proposal to be accompanied by Bid Security in the form and in the amount required shall render such Bid Proposal to be non-responsive and rejected by the District. Payment and Performance Bonds The successful bidder shall be required to furnish a 100% Payment Bond and a 100% Performance Bond if it is awarded the contract for the Project. No Withdrawal of Bid Proposals. The District's Board reserves the right to reject any and all bids and/or waive any irregularity in any bid received. If the District awards the Contract, the security of unsuccessful bidder(s) shall be returned within sixty (60) days from the time the award is made. Bid Proposals shall not be withdrawn by any Bidder for a period of Ninety (90) calendar days after the opening of Bid Proposals. During this time, all Bidders shall guarantee prices quoted in their respective Bid Proposals. Award of Contract. The Contract for the Work, if awarded, will be by action of the District Board of Education to the responsible Bidder submitting the lowest priced responsive Bid Proposal. If Alternate Bid items are included in the bidding, the lowest priced Bid Proposal will be determined on the basis of the Base Bid Proposal or on the Base Bid Proposal and the combination of Alternate Bid items selected in accordance with the applicable provisions of the Instruction for Bidders. Prequalification. General Contractors with 'B' license, and any mechanical, electrical, and plumbing contractors and subcontractors with C36 and C42 licenses must be prequalified no later than Monday, June 3, 2019.
