The City of Anderson reserves the right to delete any section(s) of the bid proposal. Said materials, supplies, and work to be furnished or performed shall comply with the requirements as may be designed by the Board of Public Works which shall include the City's right to have an independent testing laboratory test asphalt materials for liquid asphalt content. All bids shall be placed in a sealed envelope and identified by the name and address of the bidder and statement "2019 Anderson Street Resurfacing Bid". Failure of bidder to enter into a contract, execute same and furnish acceptable labor and materials and performance bond as hereinafter required, shall be cause for forfeiture of certified check or bid bond for liquidated damages to the City. The contractor must conform to the antidiscrimination provisions of I.C. 5- 16-6, et. Seq. The performance bond and labor and material payment bond shall be for one hundred percent (100%) of the contract amount and shall accompany the executed contract. Bonds shall stay in effect for twelve (12) months after completion and acceptance of the project. Bidder will not be permitted to withdraw his bid for (60) days from the date of bid opening. The need for insurance protection against theft of or damage to materials or contractor's tools or equipment at the job site shall be the bidder's decision and expense, exclusively. The Board of Works reserves the right to waive informalities or reject any and all bids.
