As of 01/02/2019, intent to award has already been issued, and This item will be presented to the Port of Palm Beach Board of Commissioners at the January 23rd 2020 meeting for approval. Estimated Cost ; Between : $1,000,000 to 1,250,000 For Berth 1 Shore Power Replacement at the Port of Palm Beach As applicable, the Purchasing Department is no longer holding public bid/proposal openings due to the provisions of Section 119.071 (1) (b) F.S., the Florida Public Records Law. Therefore, the Port is not required to provide information until the earlier of the Port providing notice of an intended decision, or until thirty (30) days after opening the bids/proposals. Further, if the intended decision is to reissue the solicitation, the Port is not required to provide information until notice of an intended decision concerning the reissued solicitation or until the reissued solicitation is withdrawn. Project consists of the construction of new shore power stations, including panels, breakers, cabling, direction drilling, manholes and all related electrical power distribution; the restoration of pavement and upland appurtenances at the Port of Palm Beach, Riviera Beach, Florida. Each Bid shall be accompanied by Bid Security in the form of a surety company Bid Bond, cashiers or certified check, drawn upon any State or National Bank in Florida, payable to the Port in an amount not less than five percent (5%) of the amount of the Berth 1 Shore Power Replacement Project Base Bid Amount. Any bid received without Bid Security will be rejected and returned. Bid Security will be returned to all except the three lowest Bidders within seven (7) days after the opening of Bids, and the remaining Bid Securities will be returned within seven (7) days after the Port and the awarded Bidder have executed the Contract, or if no Contract has been awarded, within ninety (90) days after the date of opening of Bids, or upon demand of Bidder at any time thereafter, so long as it has not been notified of acceptance of its Bid. The Bond executed by the Bidders shall be issued by a Surety Company licensed to do business in the State of Florida. If the Bidder to whom the Contract is awarded does not execute the Contract and furnish the required documentation within ten (10) days of the date of Notice of Award, the Bid Security shall be paid to the Port as liquidated damages. The Bidders agree with the Port that the amount of Bid Security fairly and reasonably represents the amount of damages the Port will suffer due to the failure of the Bidder to fulfill its obligations required herein. Bidders will be permitted to withdraw their Bids at any time prior to Bid opening. The successful Bidder shall be required to execute Performance and Payment Bonds in the amount of one hundred percent (100%) of the Contract amount. The bonds are subject to approval by the Port. The Port will not award a Contract to any Bidder who cannot prove to the satisfaction of the Port that the Contractor's project leadership (superintendent at site, and project manager part time at site) each individually have a minimum of ten (10) years of experience in commercial electrical construction including but not limited directional drilling and other types of construction called for in the Contract Documents. The Port will not award a Contract to any Bidder who cannot prove that the Company is financially able and organized to successfully carry out the Work covered by the Contract Documents in the required time by showing relevant experience of the company in completing large scale projects of a similar size or larger to this project. Proof of meeting these criteria shall be provided with the Bidder's Qualification Form to be submitted with their bid. In order for their Bid to be considered, Bidder must have a valid license (for the Work to be performed) and acceptable to the building department at time of submitting their Bids. A copy of the Bidder's license, in the name of the Bidder shown on the Bid Proposal Page, must be submitted with the Bid. Should Bidder's license and certification not be current as referenced in this paragraph, the Bid shall be rejected. Sealed Bids shall be addressed to the Port of Palm Beach District and plainly marked "BERTH 1 SHORE POWER REPLACEMENT" on the outside of the envelope. The Bidder's name and address shall also be included on the outside of the envelope. 10. The Bidder agrees that the Bid shall be good, and may not be withdrawn for a period ending the later of one hundred and twenty (120) calendar days after Bid Opening, or the execution of the Contract between the successful Bidder and the Port. The Owner will incur substantial financial loss if the Work is not substantially complete by the date set forth in the Construction Contract. The Contractor (and its surety) shall be liable for liquidated damages in accordance with the Construction Contract. The Port reserves the right to waive any technicalities/irregularities and/or to reject any and/or all Bids. The Port further reserves the right to award a contract to that Bidder whose submittal best serves the interests of the Port, in the sole discretion of the Port.
