All bids must be made on the forms furnished by the Indio Water Authority with the Project name and Identification number typed or clearly printed on the lower left corner of the package. Each bid must be submitted in a sealed package addressed to the Secretary of the IWA. Bids must remain valid and shall not be subject to withdrawal for sixty (60) Days after the bid opening date. The latest edition of Standard Specifications for Public Works Construction(Standard Specifications) are incorporated into these Contract Documents by this reference, as amended by the provisions of these Contract Documents. The Work described herein shall be done in accordance with the provisions of the Standard Specifications insofar as the same may apply, and in accordance with these Contract Documents. The Project includes, without limitation, furnishing all necessary labor, materials, equipment and other incidental and appurtenant Work necessary to complete the grading, fencing and signage improvements described by the precise grading plan prepared by MSA Consulting, Inc. for the "Posse Park Trailhead Temporary Parking Lot" dated May 30, 2019, which plan is hereby incorporated into this Agreement. This Work will be performed in strict conformance with the Contract Documents, permits from regulatory agencies with jurisdiction, and applicable regulations. The quantity of Work to be performed and materials to be furnished are approximate only, being given as a basis for the comparison of Bids. Actual quantities of Work to be performed may vary at the discretion of the Indio Water Authority Engineer Electronic copies can be obtained at no charge by emailing drudisel@indio.org. Anyone obtaining Contract Documents must immediately supply the Indio Water Authority Engineer with a facsimile number and email address such that Addenda and other information may be transmitted as rapidly as possible. Failure to provide such a facsimile number and email address may result in late notification. The IWA does not guarantee that it will provide any information by facsimile, email or both. A bidder shall be responsible for all addenda regardless of whether bidders receive any such fax or email, and a bidder shall have no recourse due to not receiving such facsimile, email or both. If you discover any error, omission, ambiguity or conflict in the Plans or Specifications and wish to have a clarification, please fax or email your request for clarification to the Indio Water Authority Engineer such that it is received by him or her no later than ten (10) Days before Bid opening. Requests for clarification received after this date will be disregarded. Please indicate the Project and identification number in your request for clarification. In accordance with Labor Code Section 1770 et seq., this Project is a "public work," and thus, the Contractor and any Subcontractors must pay wages in accordance with the determination of the Director of the Department of Industrial Relations ("DIR") regarding the prevailing rate of per diem wages. Copies of those rates are on file with the Indio Water Authority Engineering Manager, and are available to any interested party upon request. Contractor shall post a copy of the DIR's determination of the prevailing rate of per diem wages at each job site. The Contractor shall provide insurance in accordance with Section 7.3 of the Standard Specifications and Section 7.C of the General Provisions. In addition, the Contractor shall guarantee and warranty all Work against defective workmanship and materials furnished by the Contractor for a period of one (1) year from the date the Work was completed and accepted by the Indio Water Authority. The bidder shall possess a valid Class A general engineering Contractors license, or C-12 Earthwork and Paving Contractors license. Contractor's license shall be issued and in good standing by the California state Contractors license board at the time of the bid submission. The successful contractor must also possess a current City of Indio business license. This project is subject to compliance monitoring and enforcement by the Department of Industrial Relations (DIR). The requirement to only use registered contractors and subcontractors on public works projects applies to all projects awarded on or after April 1, 2015. Five percent (5%) of any progress payment will be withheld as retention. In accordance with Public Contract Code Section 22300, and at the request and expense of the Contractor, securities equivalent to the amount withheld may be deposited with Indio Water Authority or with a State or federally chartered bank as escrow agent, which shall then pay such moneys to the Contractor. Upon satisfactory completion of the Contract, the securities shall be returned to the Contractor. Alternatively, Contractor may request that the Indio Water Authority make payments of earned retentions directly to an escrow agent at Contractor's expense. No such substitutions shall be accepted until all related documents are approved by the Indio Water Authority Attorney. Requests to substitute an equivalent item for a brand or trade name item must be made by written request to the Indio water authority engineering manager a minimum of 10 days prior to the bid opening date. Requests received after this time shall not be considered. Requests shall clearly describe the product for which approval is requested, including all data necessary to demonstrate acceptability. If the product is acceptable, an addendum shall be issued so indicating. All Work shall be completed within sixty (60) calendar days following the date specified in the written Notice to proceed from the Indio Water Authority. There will be a two hundred and fifty dollars ($250) assessment for each calendar day that Work remains incomplete beyond the time specified for the completion of the Work in the Contract Documents. The Indio Water Authority reserves the right to reject any Bid or all Bids and to waive any irregularities or informalities in any Bid or in the bidding and to make awards in all or part in the best interest of the Indio Water Authority.
