Miscellaneous Drainage Improvements in Marion County - Phase 1 A Bid Bond or certified check in an amount not less than five percent (5%) of the amount bid must be submitted with each Bid. A one hundred percent (100%) Performance and Payment Bond will also be required of the successful Bidder. The City ofIndianapolis reserves the right to reject any or all bids or to waive any informalities and to accept the bid which it deems most favorable to the interests ofthe City after all bids have been examined and canvassed. The Citv-Countv Council, General Ordinance Zl, 2016,1C 4-13.6-4-2,5(d). and IC8-23-10-0.5(d) add new requirements for bids on public works projects. Please Note: Pursuant to 1C 4-13-18-5, the Bidder must submit with the Bid a written plan for a program to testthe Bidder's employees for drugs. For more information, please see Proposal Package, Bid-11, and Indiana Code (1C) Additional Requirements, AR-11. City-County Council, General Ordinance 21, 2016, IC4-13.6-4-2.5(d) , and 1C 8-23-10-0.5(d) add new requirements for bids on public works projects. Public works bid packets have now been updated to require the following: 1. List offormer business names; 2. List of any determinations by a court or government agency for violations offederal, state, or local laws including but not limited to violations of contracting or antitrust laws, tax or licensing laws, environmental laws, the Occupational and Safety and Health Act ("OSHA"), or federal Davis-Bacon and related acts; 3. Statement describing the Bidder's full-time staffing capabilities and intended additional labor (skilled labor and unskilled labor), sources from which labor will be derived on this public works project; 4. Statement listing and describing any federal, state, or local tax liens or tax delinquencies owed to any federal, state, or local taxing body in the last 5 years. Additionally, the Bidder will be required to certify to the following: 1. That Bidder is eligible to work in the State of Indiana; 2. That Bidder's labor force participates in apprenticeship ortraining programs approved by and registered with the United States Department of Labors Office of Apprenticeship, or its successor organization; 3. That Bidder will utilize project managers and superintendents with sufficient relevant management experience to complete bidder's scope of work; 4. That Bidder and its management personnel possess any and all professional trade licenses required by law for any trade or specialty area in which Bidder is seeking a contract award, and said licensures have not been suspended or revoked within the previous five (5) years; 5. That Bidder is utilizing a surety company which is on the United States Department of Treasury's listing of approved sureties; and 6. For contracts estimated to be over $300,000.00, that Bidder and expected subcontractors are qualified under IC 4-13.6-4 or 1C 8-23-10. If the Bidder is the apparent low bidder, it will be required to submit proof of those certifications within 72 hours of bid-openingBidders shall assure that they have obtained complete sets of drawings and Contract Documents and shall assume the risk of any errors or omissions in Bids prepared in reliance on incomplete sets of drawings and Contract Document This Work will be funded by the City of Indianapolis. The participation goal for MinorityBusiness Enterprise (MBE) forthis contract is fifteen percent (15%). The participation goal for WomenBusiness Enterprise (WBE) for this contract is eight percent (8%). The participation goal for VeteranBusiness Enterprise (VBE) is three percent (3%). The participation goal for Disability-owned BusinessEnterprise (DOBE) is one percent (1%).
