Site work and new construction of a golf course in Bettendorf, Iowa. Completed plans call for the construction of a golf course; and for site work for a golf course.

The proposed improvements consist of the following: Site preparation, silt fence installation, staking and minor removals. Constructing a new putting course in the area between the existing driving range and parking lot. Construction includes: topsoil stripping and replacement, rough grading, installation of catch basins, perforated and non-perforated drain pipe, and drainage outlet structures, golf course greens construction with USGA greensmix, golf course tee construction with USGA greensmix, irrigation improvements, finish grading, seeding, sodding, and installation of erosion control fabric. A Proposal Guarantee shall accompany each bid as a security that if awarded a contract by the City of Bettendorf, Iowa, the bidder will enter into the Contract at the prices bid and furnish the required Performance, Payment and Maintenance Bond in the full amount of the proposed Contract. Said security may be forfeited to the City of Bettendorf and the proceeds retained as liquidated damages if the bidder to whom a Contract is awarded fails to execute the Contract or furnish the required Performance, Payment and Maintenance Bond within ten (10) days after being notified of the award of a Contract The Proposal Guarantee shall be a certified cashiers check drawn upon an Iowa bank or a bank chartered under the laws of the United States or a Credit Union Share Draft drawn upon a Credit Union chartered under the laws of Iowa, payable to the City Treasurer, City of Bettendorf, Iowa, or a bid bond on the City of Bettendorf Bid Bond form. The amount of the Proposal Guarantee shall be twenty thousand dollars and no cents ($20,000). The project will be awarded based on the following criteria; total project costs, total of alternates, and that which falls in the best interest of serving the City of Bettendorf as determined by the City Council upon acceptance of bids. The bidder to whom the Contract is awarded will be required to furnish a Performance, Payment and Maintenance Bond on the form provided in the Proposed Contract Documents from an acceptable surety in the full amount of the proposed Contract guaranteeing the faithful performance of the Contract and the maintenance of said improvements in good repair for not less than four (4) years from the date of acceptance of the improvements by the City. A deposit of money, a certified check on a solvent bank of the county in which the improvement is to be located, a credit union certified share draft, state or federal bonds, bonds issued by a city, school corporation, or county of this state, or bonds issued on behalf of a drainage or highway paving district of this state may be received in an amount equal to the amount of the bond and held in lieu of a surety on the bond, and when so received the securities shall be held on the terms and conditions applicable to a surety. The bidder to whom a Contract is awarded shall commence work on said Contract as weather permits on Monday, April 6, 2020 with Final Acceptance of the project to occur on or before Friday, August 21, 2020. The Contractor shall notify the City a minimum of 14 calendar days prior to commencing work on the project. The proposed work shall be completed as noted in the Special Conditions. The City of Bettendorf reserves the right to hold all bids for 30 days before a Notice of Award is delivered to the apparent successful bidder. The Contract Completion Date shall be August 21, 2020 regardless of the contract start date. Liquidated damages shall be as outlined below. For any calendar day after August 21, 2020 that the project has not reached final completion, including the seeding and finishing, the Contractor will be assessed liquidated damages in the amount of Five Hundred Dollars ($500) per day. The total amount so payable by the Contractor as liquidated damages either may be deducted from any monies due or payable to the Contractor by the City or so much thereof as is not so deducted shall be chargeable to and will be payable promptly by such Contractor and his Surety, or either of them, to the City. Such liquidated damages shall be payable to reimburse or compensate, at least in part, the City for (1) the administration of the work covered by such contract or contracts beyond the Contract Completion Date, including the additional expense to the City for supervision, inspection, and superintendence; (2) expenditures resulting from the inability of the City (and the general public) to use the improvement being constructed from and after such Contract Completion Date until the actual date of completion; (3) other miscellaneous obligations and expenditures incurred by the City directly as a result of the failure to complete the work covered by such contract on or before the Contract Completion Date. Any requests for additional calendar days on the project shall be provided to the City of Bettendorf or their representative within 10 days of the cause of the delay. Any request for additional days, which is made more than 10 days after the day in question, will not be considered. Payments will be made in checks drawn upon the City Treasurer from any fund from which payment for such work may be legally made. Periodic progress payments will be paid in the manner outlined in the Special Conditions. The City will complete an online application to register this Contract with the Iowa Department of Revenue and Finance. At or before the time the Performance Bond is filed the Contractor shall provide a listing to the city identifying all subcontractors. The City will distribute tax exemption certificates and authorization letters to the Contractor and all subcontractors who have been identified. These tax exemption certificates and authorization letters are applicable only for the work under this Contract. The Contractor and subcontractors may make copies of the tax exemption certificates and present it to each supplier providing construction materials for this project. Upon completion of the Contract and before acceptance thereof by the City of Bettendorf, the Contractor shall furnish the City, in duplicate on Form 35-002 a certified list of all sales taxes and/or use taxes paid by him in connection with the execution of the Contract. The Contractor shall also require each of their subcontractors to keep similar records and to furnish a sufficient number of such certificates so that they may furnish duplicates thereof to the City. For all City of Bettendorf Capital Improvement Projects let on or after March 26, 2002, the contractors work and any subcontractors work will undergo a standardized evaluation upon completion. The contractors eligibility status for being awarded future Capital Improvement Projects will be governed by current policies adopted by the City of Bettendorf Council, which will include but not be limited to the evaluation results. By virtue of statutory authority, a preference will be given to products and provisions grown and produced within the State of Iowa and to Iowa domestic labor. A preference will be given to resident bidders in accordance with Chapter 23 of the Code of Iowa. The City reserves the right to reject any and all bids and to waive any informalities in the bidding
