Renovation of an educational facility in Simi Valley, California. Completed plans call for the renovation of a educational facility.
The Project. The Project involves renovation of an existing Multi-Purpose Building and other work identified in the plans & specifications. Funding Amount. The amount of funding for the Project, as that term is used at California Public Contract Code 20103.8(c), is Ten Million Dollars ($10,000,000.00). Prequalification to Bid. In accordance with Public Contract Code section 20111.6, a Bid Proposal shall not be accepted unless a Bidder: a) submits a Prequalification Application and Supplemental Qualifications Documentation in accordance with the Instructions for Bidders at least ten (10) business days prior to the last date for the submission of Bid Proposals set forth above, and has been prequalified for at least five (5) business days prior to that date; and, b) submits with its Bid Proposal a Subcontractors List in accordance with the Instructions for Bidders on which the listed caisson, mechanical, electrical, and plumbing subcontractors have submitted a Prequalification Application in accordance with the Instructions for Bidders at least ten (10) business days prior to the date fixed for the public opening of sealed bids set forth above, and each and every one of such subcontractors has been prequalified for at least five (5) business days prior to that date. Subcontractors holding the following license classifications must attain MEP subcontractor prequalification, regardless of whether they are installing "electrical, mechanical, or plumbing components": C-4, C-7, C-10, C-16, C-20, C-34, C-36, C-38, C-42, C-43, and/or C-46 licenses. In addition, the caisson contractor/ subcontractor who must hold an A-General Engineering or C-61 Limited Specialty with a sub-category of D-30 Pile Driving and Pressure Foundation Jacking License must become prequalified. A Prequalification Application specific to the caisson contractor / subcontractor is included in the Project Manual. The District maintains a list of prequalified MEP subcontractors which is available on the District's website. MEP subcontractors interested in becoming prequalified can complete and submit an application for prequalification. The Prequalification Application(s) and Supplemental Qualifications Documentation requirements are included in the Project Manual. Documents Accompanying Bid Proposal. Each Bid Proposal shall be accompanied by: (a) Bid Security; (b) Subcontractors List; (c) Non-Collusion Declaration; (d) Certification of Contractor and Subcontractor(s) DIR Registration, (e) Certification of Prevailing Wage & Related Labor Requirements, and (f) Iran Contracting Act Form. The Bidder acknowledges that if this Bid Proposal and the foregoing documents are not fully in compliance with applicable requirements set forth in the Call for Bids, the Instructions for Bidders and in each of the foregoing documents, the Bid Proposal may be rejected as non-responsive. Contractors' License Classification. Bidders must possess the following classification of California Contractors License at the time that the Bid Proposal is submitted and at time the Contract for the Work is awarded: B - General Building. The Bid Proposal of a Bidder who does not possess a valid and in good standing Contractors' License in the classification set forth above will be rejected for non-responsiveness. Bidder and Subcontractors DIR Registered Contractor Status. Each Bidder must be a DIR Registered Contractor when submitting a Bid Proposal. The Bid Proposal of a Bidder who is not a DIR Registered Contractor when the Bid Proposal is submitted will be rejected for non-responsiveness. All Subcontractors identified in a Bidder's Subcontractors' List must be DIR Registered contractors at the time the Bid Proposal is submitted. The foregoing notwithstanding, a Bid Proposal is not subject to rejection for non-responsiveness for listing Subcontractor the Subcontractors List who is/are not DIR Registered contractors if such Subcontractor(s) complete DIR Registration pursuant to Labor Code 1771.1(c)(1) or (2). Further, a Bid Proposal is not subject to rejection if the Bidder submitting the Bid Proposal listed any Subcontractor(s) who is/are not DIR Registered contractors and such Subcontractor(s) do not become DIR Registered pursuant to Labor Code 1771.1(c)(1) or (2), but the Bidder, if awarded the Contract, must request consent of the District to substitute a DIR Registered Subcontractor for the non-DIR Registered Subcontractor pursuant to Labor Code 1771.1(c)(3), without adjustment of the Contract Price or the Contract Time. Prevailing Wage Rates. Pursuant to California Labor Code 1773, the Director of the Department of Industrial Relations of the State of California has determined the generally prevailing rates of wages in the locality in which the Work is to be performed. Copies of these determinations, entitled "PREVAILING WAGE SCALE" are maintained at the District's Administrative Offices at 101 West Cochran Street, Simi Valley, California 93065 and are available for review on the internet at Portal. The Contractor awarded the Contract for the Work shall post a copy of all applicable prevailing wage rates for the Work at conspicuous locations at the Site of the Work. The Contractor and all Subcontractors performing any portion of the Work shall pay not less than the applicable prevailing wage rate for the classification of labor provide by their respective workers in execution of the Work. Contract Time. Substantial Completion / Final Completion of the Work shall be achieved within the time set forth in Contract Documents. Failure to achieve Substantial Completion / Final Completion within the Contract Time will result in the assessment of Liquidated Damages as set forth in the Contract. Disabled Veteran Business Enterprises ("DVBE") Participation Goal. Pursuant to Education Code 17076.11, the District has promulgated a Disabled Veteran Business Enterprises (DVBE) Program, which establishes a three percent (3%) Participation Goal for DVBEs. District Standards. In accordance with California Public Contract Code Section 3400, a designee of the District has made a finding that particular materials, products, and services are to be designated in the Contract Documents by specific brand or trade name for the following purpose: in order to match other products in use on a particular public improvement either completed, or in the course of completion ("District Standards"). The District Standards are designated elsewhere in the Contract Documents. Bid Security. Each Bid Proposal shall be accompanied by Bid Security in an amount equal to TEN PERCENT (10%) of the maximum amount of the Bid Proposal, inclusive of any additive Alternate Bid Item(s). Failure of any Bid Proposal to be accompanied by Bid Security in the form and in the amount required shall render such Bid Proposal to be non-responsive and rejected by the District. No Withdrawal of Bid Proposals. Bid Proposals shall not be withdrawn by any Bidder for a period of ninety (90) days after the opening of Bid Proposals. During this time, all Bidders shall guarantee prices quoted in their respective Bid Proposals. Waiver of Irregularities. The District reserves the right to reject any or all Bid Proposals or to waive any irregularities or informalities in any Bid Proposal or in the bidding. 16. Award of Contract. The award of a contract for the Work, if awarded, will be by action of the District's Board of Education to the responsible Bidder submitting the lowest priced responsive Bid, based on the sum of the Bid Proposal Amount plus Alternate Bid Item No. 2.
