Site work and new construction of a transportation facility in Fryeburg, Maine. Completed plans call for the construction of a transportation facility; and for site work for a transportation facility.

Bids must be submitted in a Sealed envelope, clearly marked with the project title and EDA Investment number and AIP number, the bidders name, the bidders address, and the time and date of the opening of bids as specified above. Bids submitted by FedEx, UPS, or other parcel delivery service shall have the Sealed envelope containing the Bid Proposal placed inside the shipping carton. Per the project title above, the Base Bid of the project includes construction of a new hangar; new apron and taxilane pavement; installation of utility connections and utilities; airfield electrical; pavement removal; safety plan compliance; disposal of excess material offsite; restoration; and other ancillary work. The deduct alternates include a concrete floor sealing, stone masonry veneer, metal awnings (3) and translucent panel system. Substantial Completion of all work shall be obtained by June 30, 2021; All punch list and closeout documentation shall be completed, submitted and accepted by August 31, 2021. Work shall begin as of the date specified in the Notice to Proceed. Additional contract time restrictions exist for work areas as described in the Special Provisions section of the Contract Documents. In the event the construction is not completed within the time specified, the Eastern Slope Airport Authority may retain the sum of One Thousand Eight Hundred Dollars ($1,800.00), unless otherwise specified in the contract documents, for each calendar day thereafter, Sundays and holidays included, that the work remains incomplete, not as a penalty, but as liquidation of a reasonable portion of damages that I-2 MJ/18020.06 will be incurred by the Owner by failure of the Contractor to complete the work within the time stipulated. All bids must be accompanied by a Proposal Surety equal to 5% of the bid amount (Bid Bond or other instrument as described in the Instructions to Bidders). Proposal Surety of the 2 lowest responsible Bidders that have submitted proposals that comply with all the provisions required to render them formal will be retained until the Contract and Bonds have been signed by all parties. Proposal Surety of all other bidders will be returned or released as soon as it is practical. For this proposal the Engineers Estimate ranges from $1,800,000 to $2,300,000. Copies of the Contract Documents including Plans, Specifications, Proposals, and addendums (if issued) will be available for examination Addendums and other additional or revised Contract Documents will be available on the website only and it is the Bidders sole responsibility to check the website for additions or revisions up to the day prior to the due date for Proposals . Addendums and other additional or revised Contract Documents will not be transmitted directly to Bidders or Plan Holders. From the time of advertising until the actual bid opening for this Contract, all prospective Bidders, Contractors, Subcontractors, and Suppliers shall direct all inquiries related to this project solely to Matthew OBrien, Project Manager, McFarland Johnson, at mobrien@mjinc.com. The deadline for submitting inquiries related to this project is April 10, 2020. All work under this project must comply with Davis-Bacon regulations as described in the Contract Documents. Federal Wage Rates are included in the Contract Documents. State of Maine Wages do not apply to this project. The Bidding Procedures are as outlined in the Instructions to Bidders. A successful Bidder entering into a contract for any portion of the work included in a proposal shall provide the Owner sufficient surety in the form of 100% Performance and Payment Bonds as outlined in the Supplemental General Provisions. The Owner will not discriminate against any bidder because of race, color, religion, sex, or national origin. This project will be partially funded with Federal funds from the United States Department of Commerce, Economic Development Administration and therefore is subject to Federal laws and regulations associated with that program. In this bid process and the resulting Contract, if executed, all Bidders and Contractors must fully comply with the Required Contact Provisions for Airport Program and for Obligated Sponsors contained within the Contract Documents. The Contractor must comply with the Federal Disadvantaged Business Enterprise (DBE), Small Business, Equal Employment Opportunity (EEO), and Affirmative Action Requirements contained within the Contract Documents. 2020 Aviation projects sponsored by the Town of Fryeburg utilize race-neutral DBE procedures. There is a project-specific DBE goal for this project of 3.2% using Race-Conscious practices. Bidders must comply with the requirements of 49 CFR Part 26, including Appendix A, which I-4 MJ/18020.06 discusses making good-faith efforts, to ensure that all DBEs and Small Businesses are afforded the maximum opportunity to work with them on federally funded projects. The Town of Fryeburg has an overall DBE goal of 3.2% for FAA funded projects in Federal Fiscal Year 2020. The Bidder/Offeror will be required to submit the following information: (1) the names and addresses of DBE firms that will participate in the contract; (2) a description of the work that each DBE firm will perform; (3) the dollar amount of the participation of each DBE firm participating; (4) written documentation of the Bidder/Offerors commitment to use a DBE Subcontractor whose participation it submits to meet the contract goal; (5) written confirmation from the DBE that it is participating in the contract as provided in the commitment made under (4); and (6) a list or DBE and Small Businesses contacted, or who provided quotes as potential Subcontractors under this bid. The Affirmative Action goals for minority and female participation, expressed in percentage terms for the Contractors aggregate workforce in each trade on all construction work in the covered area, are as follows: Goals for minority participation for each trade ...................................... 0.5% Goals for female participation in each trade......................................... 6.9% The bidder agrees to comply with 49 USC 50101, which provides that Federal funds may not be obligated unless all steel and manufactured goods used in AIPfunded projects are produced in the United States, unless the FAA has issued a waiver for the product; the product is listed as an Excepted Article, Material Or Supply in Federal Acquisition Regulation subpart 25.108; or is included in the FAA Nationwide Buy American Waivers Issued list. A Bidder must submit the appropriate Buy America certification contained in the Proposal with all bids on AIP funded projects. Bids that are not accompanied by a completed Buy America certification will be rejected as nonresponsive. The Contractor or Subcontractor, by submission of an offer and/or execution of a contract, must certify compliance with the Foreign Trade Restriction Clause. By submitting a proposal under this solicitation, the bidder certifies that at the time the bidder submits its proposal that neither it nor its principals are presently debarred or suspended by any Federal department or agency from participation in this transaction. A bidder must submit the appropriate Certificate Regarding Debarment and Suspension certification contained in the Proposal with all bids on AIP funded projects. Bids or offers that are not accompanied by a completed Certificate Regarding Debarment and Suspension certification will be rejected as nonresponsive. I-5 MJ/18020.06 The Town of Fryeburg, in accordance with the provisions of Title VI of the Civil Rights Act of 1964 (78 Stat. 252, 42 U.S.C. 2000d to 2000d-4) and the Regulations, hereby notifies all bidders that it will affirmatively ensure that any contract entered into pursuant to this advertisement, disadvantaged business enterprises and airport concession disadvantaged business enterprises will be afforded full and fair opportunity to submit bids in response to this invitation and will not be discriminated against on the grounds of race, color, or national origin in consideration for an award. The Town of Fryeburg complies with the Drug Free Workplace requirements in 49 CFR Part 29. The estimated quantities in the Proposal are not guaranteed but are given as a basis for the comparison of bids. No bids may be withdrawn by the Bidder prior to October 15, 2020. The proposal section includes a Proposal Checklist. If all the forms and documents listed in the Proposal Checklist for inclusion in the Proposal are not included with your Proposal and correctly executed, the Proposal may be considered non-responsive. The right is reserved to reject any or all bids, to waive any formality and any and all technicalities in bids and to accept such bids as may be deemed in the best interest of the awarding agency. *This project timeline has been extended due to the public health crisis.
