Site work for a water / sewer project in Butler, New Jersey. Completed plans call for site work for a water / sewer project.

**As of December 16, 2020, the awarded amount is $254,969.80. The project is complete. The proposed water main replacement project on Northwestern Avenue. The work to be performed shall consist of the furnishing of all labor, equipment, materials and all else necessary for the construction of approximately 995 lineal feet of 8" ductile iron water main, including new house services, hydrants and related appurtenances; and other miscellaneous related and appurtenant work. The Contract must be completed within 30 calendar days commencing 20 calendar days from the date of issuance of the Notice of Award. This Contract is subject to all of the Department of Labor Safety and Health Regulations and to the applicable provisions of the Occupational Safety and Health Act of 1970. All Fair Labor Standards Act regulations will apply to this Contract. All bids shall be made on the forms furnished and shall be enclosed in a sealed envelope marked with the name and address of the Bidder, the name of the Owner, the Contract Number and Title. Funding for this project, in part, is provided by the United States Department of Housing and Urban Development through the Morris County Division of Community Development. Therefore, all federal prevailing wage regulations as well as the Federal Labor Standards Provisions will apply. Attention is called to the fact that the contractor must ensure that employees and applicants for employment are not discriminated against because of their age, race, creed, color, national origin, ancestry, marital status, sex, affectional or sexual orientation and to the greatest extent possible, opportunities for training and employment shall be given to lower-income residents of the project area and that, when possible, contracts shall be awarded to business concerns owned by area residents. Small, Minority and Women's Business Enterprises, and Section 3 businesses (contracts over $100,000) are encouraged to submit bids. During the performance of the work, the Contractor must pay the highest between the Davis Bacon Wage Determination and the New Jersey Prevailing Wages for all areas employed. All Community Development Block Grant and Davis-Bacon Federal Regulations as per HUD will apply to this Contract. Each bid must be accompanied by a certified check, cashier's check, or bid bond in the amount of ten percent (10%) (not to exceed $20,000) of the total bid, payable to the Owner, as a guarantee that if the contract is awarded to the Bidder he will enter into a contract with the Owner. The successful Bidder will be required to furnish payment and performance bonds each in an amount equal to one hundred percent (100%) of the contract award. Each Bidder shall submit with his proposal a completed Consent of Surety Form, stating that the surety company will provide him with the required payment and performance bonds. Performance and payment bond companies must be listed under the OMB Circular 570. During the performance of this contract, the contractor shall be required to comply with the requirements of N.J.S.A. 10:5-31 et seq. and N.J.A.C. 17:27, regarding affirmative action. Each bidder must complete the Ownership Disclosure Statement, the Non-Collusion Affidavit and the Affirmative Action Assurance Form contained in the proposal package in order to be eligible for consideration for award of this Contract. In addition, when applicable, the Bidder shall be required to submit a list of specialty trade subcontractors who will be used on the Project, along with a certificate pursuant to P.L. 1997, c.408. The attention of the Bidder is called to the conditions of employment to be observed and minimum wage rates to be paid under the contract. The successful Bidder shall be required to comply with the provisions of the Department of Labor's current wage rate determination, The New Jersey Prevailing Wage Act, The Contract Work Hours and Safety Standards Act, The Davis-Bacon Act, The Copeland Act and Executive Orders 11246 and 11375. Executive Order 11246 (as amended by Executive Order 11375) requires an Affirmative Action Plan from all federal contractors and subcontractors and requires that firms with contracts over $50,000 and 50 or more employees develop and implement written programs to be monitored by the Department of Labor. Revised Order 4 covers underutilization of females and minorities and Rule 401:2741 covers payment of dues in private clubs that discriminate on the basis of race, sex, religion, and national origin. Executive Order 11246 is enforced through compliance reviews during which the employer's Affirmative Action Compliance Plan and supporting EEO policies and practices are closely scrutinized. Bidders shall be registered with the Department of Labor Division of Wage and Hour Compliance as required by the Public Works Contractor Registration Act (PWCRA) P.L. 1999, c.238-N.J.S.A. 34:11-56.48 et seq., and shall submit a copy of their registration certificate with the proposal package in order to be eligible for consideration for award of this Contract. This Contract is subject to the provisions of the Business Registration Law, P.L. 2004, c. 57, N.J.S.A. 52:32-44, and bidders must submit a copy of their registration certificate with the proposal package in order to be eligible for consideration for award of this Contract. Contract Documents for the proposed work are on file in the office of the Borough Clerk, One Ace Road, Butler, New Jersey, and at the office of the Consulting Engineer, Anderson & Denzler Associates, Inc., 519 Ridgedale Avenue, East Hanover, New Jersey, and may be inspected by prospective bidders during office hours. The Contract will be awarded to the lowest responsible bidder, as set forth in the Contract Documents, the right being reserved by the Borough to reject all proposals or any proposal which may be informal or the acceptance of which for any other reasons would be detrimental to the best interests of the Borough, and to waive informalities.
