All proposals or bids offered must be accompanied by a Bid Bond, Certified Check, Bank Draft or Cashier's Check, payable to the Town of Leyden in the amount of not less than 10% of the amount of the bid. Executed by the Bidder and surety Company licensed to do business in the State of Illinois. The bond is required as a guarantee that if the bid is accepted a contract will be entered into and the performance of it properly secured. The owner reserves the right to retain the bid security of all bidders until the successful bidder enters into the contract or thirty (30) days after the bid opening. The successful bidder for the construction of the improvement will be required to enter into a bond in a sum equal to 100% of the amount of the bid with sureties to be approved by the Town of Leyden. This surety bond shall be conditioned upon proper and faithful performance by the contractor of the work specified in accordance with the specifications therefore and the ordinance providing for the construction of the improvement, and according to the time, terms and condition of the contract.
