Provide the labor, tools, equipment, and materials necessary to furnish and install raceways, boxes, and supporting devices Each and every Bidder should attend the Pre-Bid Conference. Prospective bidders MAY NOT visit the Project Site without making arrangements. Bids will be accepted from any bidder who did not attend the Pre-Bid Conference. Bid Opening - To listen via teleconference dial: 1 (415) 930-5321 Access Code: 576-900-151# Padre Dam Municipal Water District, hereinafter called the District, in the penal sum of TEN PERCENT (10%) OF THE TOTAL BID PRICE of the Principal submitted to DISTRICT for the work described below, for the payment of which sum in lawful money of the United States, well and truly to be made, we bind ourselves, our heirs, executors, administrators, successors and assigns, jointly and severally, firmly by these presents The successful bidder will be required to furnish the District with a Performance Bond equal to 100% of the successful bid, and a Payment Bond equal to 100% of the successful bid, prior to execution of the Contract. All bonds are to be secured from a surety that meets all of the State of California bonding requirements, as defined in Code of Civil Procedure Section 995.120, and is admitted by the State of California. The Engineer estimate for the base bid is $2,062,875. The Engineer estimate for the combined base and alternate bid is $3,200,238 The Contractor shall complete all Work required by the Contract Documents within 720 calendar days from the commencement date stated in the Notice to Proceed, hereinafter the Contract Time. By its signature hereunder, Contractor agrees the Contract Time for completion set forth above is adequate and reasonable to complete the Work. The Contractor acknowledges that the District will sustain actual damages for each and every day completion of the Project is delayed beyond the Contract Time. Because of the nature of the Project, it would be impracticable or extremely difficult to determine the Districts actual damages. Accordingly, as provided in Government Code section 53069.85, it is agreed that the Contractor will pay the District the sum of [$2500] for each and every calendar day of delay in completing the Work beyond the time prescribed in the Contract Documents for finishing the Work, as Liquidated Damages and not as a penalty or forfeiture. In the event the Liquidated Damages are not paid, the Contractor agrees the District may deduct that amount from any money due or that may become due the Contractor under the Contract. This Article does not affect the District rights to other damages or remedies specified in the Contract Documents or allowed by law. Completion- 720_ calendar days
