This Pre-Qualification process is to pre-qualify General Contractors to be eligible to participate in the bidding process of the FRB South East Perimeter Access Road Improvements Project with a total contract not-to-exceed amount or estimated amount of $2,223,158, which will be advertised for public bids to the pre-qualified contractors on June 17th, 2020. Any county response relevant to this pre- qualification other than through or approved by oc public works/procurement services is unauthorized and will be considered invalid. An attached ten percent (10%) bid security by certified or cashier's check, cash, or an original bidder's bond issued and executed by an admitted surety insurer authorized to transact surety insurance in California, made payable to the order of the County of Orange as a guarantee that the Bidder will enter into the proposed contract if it is awarded to that Bidder. Within 10 calendar days after award of the Contract, the successful Bidder shall furnish a Faithful Performance Bond and a Labor and Material Payment Bond, each in an amount equal to 100% of the Contract Price, issued by a surety in accordance with the requirements of the General Conditions of the Contract. In accordance with Government Code Section 53069.85, CONTRACTOR agrees to forfeit and pay to COUNTY the sum of $1,500 per day ("Liquidated Damages") for each calendar day that completion of all the work required by the Contract Documents is delayed beyond the Contract Time, as may be adjusted by Change Order. COUNTY may deduct such sum from any payments due or to become due to CONTRACTOR. If the Liquidated Damages exceed the unpaid balance of the Contract Price otherwise owed to CONTRACTOR, then CONTRACTOR shall immediately pay COUNTY the difference. The award of the Contract, if it is awarded, will be to the lowest responsive and responsible Bidder complying with these Instructions and the Notice Inviting Bids. COUNTY reserves the right to reject the Bid(s) of all Bidders or to waive any immaterial irregularities or informalities of any Bid received.
