Renovation of a water / sewer project in Pflugerville, Texas. Completed plans call for the renovation of a water / sewer project.

furnishing all labor; material, tools and equipment and performing all work required for the City of Pflugerville Wilbarger Creek Regional Wastewater Treatment Facility UV Disinfection System Pre-Selection which consists of the Goods and Services for the UV Disinfection System as described in these contract documents. This pre-selection is for a competitive sealed proposal for equipment and related design work/schematics associated with the Wilbarger Creek Regional Wastewater Treatment Facility project (Prime Project), still under design, and which will be awarded at a later date. The selected Offeror will be required to enter into an agreement with the City in order to hold the selected proposal price until the Prime Project is awarded. At that time, the selected Offeror will enter into a subcontract with the selected Contractor (Prime Contractor) for this component of the Prime Project. Proposals must be submitted on the Proposal and Bid Schedule forms provided in Section 03 and must be accompanied by a proposal security in a penal sum of not less than five percent (5%) of the total amount of the proposal submittal. The security may be in the form of a certified check, cashier s check or proposal bond furnished by a reliable surety company having authority under the laws of Texas to write surety bonds in the amount required, with such security made payable without recourse to the City. The envelope containing the proposal shall indicate clearly on the front that it is a proposal for City of Pflugerville Wilbarger Creek Regional Wastewater Treatment Facility UV Disinfection System Pre-Selection. The Design Engineer and the City will host formal interviews with selected Offerors. The interview will be attended by Offerors key personnel identified in their Proposal, either in person or remotely. The selected Offerors will lead the interview and provide an in-depth presentation as part of the scoring process. The final Notice of Award of Contract shall be issued to the successful Offeror by the City within fifty (50) days following the opening of proposals and no Offeror may withdraw a proposal within fifty (50) days after opening thereof. The successful Offeror must furnish a performance bond and payment bond on the forms provided, each in the amount of one hundred percent (100%) of the contract amount, from a surety company authorized by the State of Texas to act as surety. The project is funded by the Texas Water Development Board (TWDB). Neither the U.S. Environmental Protection Agency (EPA) or the State of Texas, nor any of its departments, agencies, or employees are or will be a party to this Invitation or any resulting contract. Any contract awarded under this solicitation is subject to the American Iron and Steel (AIS) requirements of federal law, the Department of Labor (DOL) Equal Opportunity in Employment requirements and the Davis-Bacon Wage Rate requirements as listed below. AIS - Any contract(s) awarded under this Invitation for Bids is/are subject to the American Iron and Steel (AIS) requirements of Section 608 of the Federal Water Pollution Control Act. Offerors on this work will be required to comply with the Department of Labor regulations at 41 CFR Part 60-4, relating to Construction Contractors--Affirmative Action Requirements, which include the President s Executive Order No. 11246, as amended by Executive Order No. 11375 and Executive Order No. 13672, in the award and administration of contracts awarded under TWDB financial assistance agreements. Failure by the Contractor to carry out these requirements is a material breach, which may result in the termination of the awarded financial assistance. Davis-Bacon prevailing wage requirements apply to a construction project financed, in whole or in part, from the Clean Water State Revolving Fund (CWSRF). The Davis-Bacon prevailing wage requirements apply to Contractors and Subcontractors performing on federally funded or assisted contracts in excess of $2,000 for a construction project under the CWSRF. For prime contracts in excess of $100,000, Contractors and Subcontractors must also, under the provisions of the Contract Work Hours and Safety Standards Act, as amended, pay laborers and mechanics, including guards and watchmen, at least one and one-half times their regular rate of pay for all hours worked over 40 in a workweek. The Fair Labor Standards Act may also apply to Davis-Bacon covered contracts. U.S. Department Labor (DOL) Wage Determination - According to TWDB-0551, the City must amend the solicitation if the DOL issues a modification more than 10 days prior to the closing date (i.e., bid opening) for the solicitation. Questions regarding proposals shall be directed via email to projects@pflugervilletx.gov and shall copy gtswoboda@garverusa.com. All submitted proposals will remain confidential. The City of Pflugerville reserves the right to reject any and all proposals and to waive any informalities in proposals received; to eliminate a portion of the work or add additional work as required to keep the total contract amount within the funds budgeted; the right to award any parts or combination of parts of the project it deems necessary; and any other rights established under the laws of the State of Texas.
