For improving the WOODLAND HILLS DITCH Auglaize County, Ohio, in accordance with the plans, profiles, and specifications of the Auglaize County Engineer. The undersigned, having full knowledge of the site, conditions, plans, profiles, and specifications for the above named improvement hereby agrees to furnish all service, labors, material, and equipment necessary to complete all the TILE DRAINAGE items on or before the 1st day of JUNE, 2021 A bid bond or certified check in the amount of 10% of your bid shall accompany all bid proposals to guarantee each and every bid proposal submitted to the County Commissioners. All certified checks are to be made payable to the Auditor of Auglaize County. All bid bonds and certified checks shall be released to all unsuccessful bidders within 10 days of the County Commissioners awarding a contract to the winning Contractor. The awarded contractor must present either a performance bond, certified check or letter of credit within 10 days of the actual bid opening. The amount of bid bond or certified check shall be the same amount as his bid. The letter of credit shall be in the amount of 125% of his bid. The Auglaize County Engineer shall be the supplier of all letter of credit forms if that bonding choice is made. The Board of County Commissioners of Auglaize County reserve the right to waive any or all minor irregularities and reserves the right to accept or reject any or all bids presented to them, as they feel will best serve the interest of Auglaize County. Any or all bids received which have a total bid amount higher than the Engineers estimate shall automatically be rejected. There shall be no extensions of contract given to any Contractor who delays the start of construction and does not allow for normal breakdowns or rain out dates and unable to finish the job in item. The WOODLAND HILLS DITCH is job specific for agricultural purposes only. Therefore, all listed pipe materials as shown in this bid proposal shall be installed with a wheel trenching machine that is equipped with a laser gradient guidance system, and/or Global Positioning guidance system (gps) for grade control. The Contractor will have a TOTAL OF 90 CALENDAR DAYS to complete the Tile Ditch Construction starting from the day of the commencement of the tile ditch construction, to the last day all installed items of the contract are approved and the tile construction is considered completed. This shall include all yard and R/W repairs, seeding, fertilizing and mulching, unless the Engineer determines that insufficient settling of the trenches has not been accomplished in those areas, at which an extension of time to complete this work will be granted. The WOODLAND HILLS DITCH project WILL NOT have a crop restrictions. The awarded Contractor shall also make arrangements with the landowner, and/or the farm operator for each specific property directly affected by this project for entry and/or right-of-way access to this project, as well as the delivery of pipe, catch basins, aggregates, etc. Failure to complete the project on the scheduled completion date within the specified completion date shall be subject to penalties similar to Section 108.07 of the Ohio Department of Transportations Bidding and Specifications Manual, said section states in part: For each calendar day that any work shall remain uncompleted after the contract completion date, the sum specified as follows shall be deducted from any money due the Contractors, not as penalty, but as liquidated damages received. The amount of liquidated damages to be assessed for each calendar day of overrun in time past the contract completion date shall be in the amount of $250.00 per day as determined by the BOARD OF COUNTY COMMISSIONERS for the purposes of this Contract, and not as the amount specified by the ODOT Bidding and Specifications Manual (which states a rate $ 500.00 per day).
