All bidders must file a "Bidders Proof of Responsibility Form" with the Town of Wheatland on or before 4:00 P.M. on September 11, 2020. A certified check or bid bond payable without condition to the Town of Wheatland in an amount not less than five percent (5%) of the bid shall be submitted with each bid as a guarantee that if the bid is accepted, a proper contract and bond will be executed and filed within ten (10) days after the acceptance of the bid. If such bidder fails to execute and file such contract and bond, the amount of the check or bid bond shall be forfeited as liquidated damages. No bid shall be withdrawn after the opening of bids without the consent of the Town of Wheatland for a period of sixty (60) days after the time of opening bids. Each bidder agrees upon submission of bid that if the same be accepted within said time period, he shall be bound by the terms of acceptance hereinafter contained. The Town of Wheatland reserves the right to reject any or all bids received, or to accept any bid which may be most advantageous to, and in the best interest of Town of Wheatland. Each successful bidder will be required to furnish a satisfactory performance bond in the sum of the full amount of this contract.
