Each bid must contain either (1) a cashier's check or draft or check certified and drawn on a solvent State or National bank, in an amount equal to 10 percent (10%) of the amount of the Bid; or (2) a bid bond executed by a corporation authorized to contract as a surety in the State of Texas, in an amount not less than ten percent (10%) of the amount of the Bid. The bid security shall be made payable to the City of Dayton, TX. The bid security must not contain conditions either in the body or as an endorsement thereon. Such bid security shall be forfeited to the City of Dayton as liquidated damages in the event the successful bidder fails to or refuses to enter into a contract within ten (10) days after the award of the contract and post satisfactory Performance and Payment Bonds. Payment to the Contractor for said construction will be made from cash on hand or such other funds that legally may be used or obtained for such purposes. Estimates will be paid monthly by the City of Dayton to the Contractor in accordance with the percent of construction completed and certified; with retainage of ten percent (10%) for no less than thirty-one days after full completion and acceptance. Dayton Fiber The City of Dayton reserves the right to defer acceptance of any bid for the period not to exceed thirty (30) days after the date bids are received and no bid may be withdrawn during this period. The City also reserves the right to waive irregularities, reject any or all bids, and enter into such contract as it shall be deemed in the best interest of the City. The successful bidder will be required to furnish a Performance Bond in an amount equal to one hundred percent (100%) of the contracted price. Bonds are to be issued by responsible surety approved by the City of Dayton and shall guarantee the true performance of the contract and the terms and conditions contained. Bidder shall guarantee the prompt payment to all subcontractors and for all materials/labor. Bidder will also protect and save harmless the City of Dayton from claims and damages of any kind caused by the operations of the Bidder, and shall guarantee the work against faulty workmanship and materials for a period of three (3) years after its completion and acceptance by the City of Dayton.
