Verbal information obtained otherwise will not be considered in the awarding of the solicitation Bids over $100,000.00 shall be accompanied by a bid bond or certified cashier check in an amount equal to 5% of the bid. A performance bond satisfactory to the county, executed by a surety company authorized to do business in this state or otherwise secured in a manner satisfactory to the county, in an amount equal to 100 percent of the price specified in the contract. A payment bond satisfactory to the county, executed by a surety company authorized to do business in this state or otherwise secured in a manner satisfactory to the county, for the protection of all persons supplying labor and materials to the contractor or its subcontractors for the performance of the work provided for in the contract. The bond shall be in amount equal to 100 percent of the price specified in the contract. Project shall be substantially completed within 160 calendar days of the County Notice to Proceed. Final completion shall occur within 180 calendar days after Notice to Proceed. Liquidated Damages shall be applied as shown in the Agreement The Successful Bidder shall agree that if the Work, or any part thereof, is not completed within the time agreed and indicated in the Contract Document that he shall be liable to the County in the amount as stipulated below for each and every calendar day the completion of the Work is delayed beyond the time provided in the Contract. A) Substantial Completion: The Successful Bidder shall pay the County $1,000.00 for each day that expires after the time specified in Paragraph 17 above for Substantial Completion until the Work is substantially complete. B) Final Completion: After Substantial Completion, if the Successful Bidder shall neglect, refuse, or fail to complete the remaining Work within the Contract Times (as duly adjusted pursuant to the Contract) for completion and readiness for final payment, the Successful Bidder shall pay the County $500.00 for each day that expires after such time until the Work is completed and ready for final payment. This Proposal does not commit Berkeley County to award a Contract, to pay any costs incurred in the preparation of a Proposal or to procure or contract for the articles of goods or services. The County reserves the right to waive any informalities or irregularities, to reject any or all Bids received as a result of this request, or to cancel in part or in its entirety this Proposal, if it is in the best interest of the County to do so.
