The Project includes the following Work: Project generally consists of the construction of a new headworks building, raw sewage pumping station, a new two-basin Sequencing Batch Reactor (SBR) process, with aerobic digesters and 24-hour storage/equalization tanks, which is a pre-stressed post tensioned concrete structure, chemical addition facilities, conversion of chlorine contact tanks to a new ultraviolet (UV) disinfection system, a new solids dewatering system, demolition of some existing structures, upgrades to the electrical service and emergency generator set replacement. Bid security and Bidder s qualification to perform the Work shall be furnished in accordance with the Instructions to Bidders. It is a requirement of this Contract that at least 50% of the Work be performed by prime Bidder s own work force, not by subcontractor(s). It is a requirement of this Contract that Bidder shall have a minimum (5) years, (5) projects documented experience in the type of Work required by this Project. The cost of each project included in Bidder s questionnaire must be in excess of $ 5,000,000.00 in order to be considered project experience. Bidders, subcontractors, their workers and any persons providing labor and products to the Project shall be persons lawfully permitted to work in the United States and the State of Maryland. Bids may be modified or withdrawn by an appropriate document duly executed (in the manner that a Bid must be executed) and delivered to the place where Bids are to be submitted at any time prior to the opening of Bids. After the Bid opening, Bidder may withdraw its Bid only by complying with applicable Federal, State, or local laws and regulations. Unless prohibited by such applicable laws and regulations, or if there are no applicable laws and regulations, Bidder shall forfeit the entire amount of Bid security upon withdrawal of its Bid. Each Bid must be accompanied by Bid security in the form of a certified check, bank check, irrevocable letter of credit, or Bid bond (on the form included with the Project Manual) for 5% of the total Bid Price. Bids shall remain open for a period of 90 days from the date of Bid opening, except as may otherwise be provided in the Instructions to Bidders Successful Bidder must provide evidence of insurance, and Performance and Payment Bonds, each in an amount equal to 100% of the Contract Price, in the form and at the time set forth in the Project Manual. If a conflict exists between any Federal, State, or local law, ordinance, or regulation the most stringent requirements shall govern. Project is partially funded by USDA and by a State grant, through the Maryland Department of the Environment (MDE). The Contract is subject to the American Iron and Steel provisions of P.L. 113-76 Consolidated Appropriations Act, of 2014, as required by USDA, to the MDE requirements and contract provisions included in EXHIBIT A, which is attached to the Project Manual and to the Federal Requirements described in Article 19 of the Supplementary Conditions of the Contract. The TOWN OF SECRETARY reserves the right, which is understood and agreed to by all Bidders, to reject any or all Bids and to waive any omissions, errors, or irregularities in any Bid.
