The project scope includes, but is not limited to, the following major work items: Fill Operations to furnish, place, and compact fill material at designated site. Site Grading Proposals shall be accompanied by either a Bid Bond or certified check upon a national or statebank in an amount not less than 5% of the total maximum bid price, payable without recourse tothe Trinity River Authority of Texas as a guarantee that the bidder will, within 10 days after noticeof award, enter into a Contract and furnish a Performance Bond and Payment Bond upon theforms provided, each in the amount of 100% of the Contract Price, from a surety licensed toconduct business in Texas and named in the current "List of Certified Companies" as publishedin Circular 570 (amended) by the Audit Staff Bureau of Accounts, U.S. Treasury Department. Thesurety for the Performance Bond and Payment Bond shall have an "A" minimum rating ofperformance and a financial rating strength of five times the Contract Price, all as stated in thecurrent "Best's Key Rating Guide, Property-Casualty." Each Bond shall be accompanied by a"Power of Attorney" authorizing the attorney-in-fact to bind the surety and certified to include thedate of the Bond. OWNER and ENGINEER shall each have the authority to reject Work which does not conform to the Contract Documents, and CONTRACTOR shall promptly correct all Work so rejected, whether observed before or after Final Acceptance and whether or not fabricated, installed or completed. CONTRACTOR shall bear all costs of correcting such rejected Work, and shall not be entitled toany increase in Contract Time or increase in Contract Sum for resulting delay, and shall, by appropriate Change Order, be charged for the cost of additional engineering services incurred by OWNER.
