The contract will require contractors to provide construction services for the CONSERVATION TRAIL EXTENSION WATER, REUSE AND FORCE MAINS as more particularly described in the Bid Proposal and in accordance with the plans and specifications. Proposals will be evaluated in accordance with the criteria included in the Invitation to Bid. JEA reserves the right to reject any and all bids, make modifications to the work, award the contract in whole or in part with or without cause, provide for the delivery of the project in phases, and waive minor or technical irregularities in any bid, as it deems appropriate, if it determines in its discretion that it is in the JEA's best interests to do so. Any person who wishes to protest the Invitation to Bid, or any component thereof, shall file with JEA a written notice of protest within seventy-two (72) hours after the Invitation to Bid is made available, together with a protest bond in a form acceptable to JEA and in the amount of $10,000, and shall file a formal written protest with the JEA within seven (7) calendar days after the date of timely filing the initial notice of protest. Filing will be perfected and deemed to have occurred upon receipt by the Engineer. Failure to timely file a notice of protest or failure to timely file a formal written protest shall constitute a waiver of any right to object to or protest the contents of the Invitation to Bid. The formal written protest shall state with particularity the facts and law upon which the protest is based. Bids shall be submitted in a sealed opaque package, shall bear the name and address of the Bidder on the outside of the package and shall identify the name of the project. If the proposal is sent through the mail or other delivery system, the sealed envelope shall be enclosed in a separate envelope with a notation "RESPONSE TO INVITATION TO BID FOR SONOC Company, LLC, on behalf of JEA, AND IN CARE OF ENGLAND-THIMS & MILLER, INC. England-Thims & Miller, Inc. will conduct a bid opening on Friday. at the England, Thims & Miller's office to open the bids. No official action will be taken at the meeting. The bids will be evaluated by ETM and JEA. The Bid Opening is open to the public and will be conducted in accordance with the provisions of Florida law including but not limited to Chapter 190, Florida Statutes. Each bid shall remain binding for a minimum of ninety (90) days after the bid opening. The successful Bidder will be required upon award to furnish a payment and performance bond for one hundred percent (100%) of the value of the contract, with a Surety acceptable to JEA, in accordance with Section 255.05, Florida Statutes.
