The Power of Attorney for the attorney in fact of the surety must be current and attached to the bond. The signature of the attorney in fact shall be notarized. The faithful performance security shall be in a sum not less than one hundred percent (100%) of the total contract price, in the form of the attached Performance Bond. Pursuant to Civil Code Sections 9550 and 9554, the CONTRACTOR shall file a payment bond with and approved by the AGENCY. The payment bond shall be in a sum not less than one hundred percent (100%) of the total contract price. The payment bond shall be in the form of the attached Payment Bond and not a deposit in lieu of a bond. All questions or requests for information of a technical nature should be directed to the Project Manager. The AGENCY reserves the right to reject any or all bids, to waive any irregularity, and to take all bids under advisement for a period of thirty (30) days after the date the bids are publicly opened.
