ADVERTISEMENT AND NOTICE TO BIDDERS NOTICE IS HEREBY GIVEN that sealed bids addressed to: Attn: Ziad Shehady, Borough Administrator, 90 Monmouth Street, Red Bank, NJ, will be received up to 10:00 AM prevailing time on Tuesday, April 20, 2021 at which time and place bids will be opened and read aloud outside of 90 Monmouth Street, Red Bank, New Jersey 07701 for the following: EAST SIDE PARK, MOHAWK POND PARK, AND COUNT BASIE PARK IMPROVEMENTS GENERAL DESCRIPTION OF THE PROJECT: The project generally consists of various upgrades to East Side Park, Mohawk Pond Park and Count Basie Park, located in Red Bank, New Jersey. The proposed work includes ball field improvements, playground surfacing, concrete walkways and pad, a new steel pavilion, site furnishings, solar powered LED lighting, and any and all associated work. OBTAINING CONTRACT DOCUMENTS: Contract Documents, Plans, Specifications and Bid Proposal Sheets may be obtained during normal business hours at the Office of the Borough Engineer, Gregory R. Valesi, PE, PP, CME, of CME Associates, 1460 Route 9 South, Howell, New Jersey until 48 hours prior to the time set for the opening of bids upon payment of $30.00 per set. No refunds will be made except as provided in N.J.AC. 40A:1124b which allows for the return of documents in reasonable conditions within in ninety (90) days of notice that the contract has NOT been awarded. The said Contract Documents and Proposal sheets may be examined at 90 Monmouth Street, Red Bank, New Jersey 07701. BID SUBMISSION PROCEDURES: Bids must be submitted on the Bid Form contained in the Contract Documents and must be enclosed in a sealed envelope plainly marked on the Outside with the name of the project and the name and address of the Bidder. The bids must be addressed to Ziad Shehady, Borough Administrator, 90 Monmouth Street, Red Bank, NJ. The bid must be delivered to the Owner prior to the Bid opening at the above address for submitting bids. Bids will not be accepted after 10:01 AM prevailing time on Tuesday, April 20, 2021. Bidders are strongly encouraged to mail in their bid package. If bids are to be dropped off in person, it must be done by appointment in coordination with the Clerk's Office (732-530-2740, 90 Monmouth Street, Red Bank). If a vendor determines that it is absolutely necessary to attend the official bid opening, please be advised that the Borough will enforce appropriate protocols of social distancing to limit exposure of pathogens. In order to limit the exposure of pathogens, the Borough will not be allowing vendors to immediately review any submission documentation at the opening. If a vendor requires information regarding the submissions, they shall contact the Borough Engineer's office (Laura Neumann) at (732) 462-7400. BID SECURITY: Each bid must be accompanied by a certified check or cash of not less than ten (10%) percent of the bid, but not more than $20,000.00, payable without any conditional endorsement as a guarantee that in case the contract is awarded to the bidder, he will within ten (10) days thereafter execute such contract and furnish satisfactory performance bonds. Upon failure to do so, he shall forfeit the deposit as liquidated damages and the acceptance of the bid will be contingent upon the fulfillment of this requirement by the bidder. No interest shall be allowed upon any such certified check or cash. A bid bond in the amount of ten (10%) percent of the bid, but not more than $20,000.00, may be substituted for certified check or cash. Each bid must be accompanied by a Certificate of Experience and Certificate of Equipment. Each bid must also be accompanied by a certificate of Consent of Surety from a bonding company licensed to do business in the State of New Jersey guaranteeing that if the proposal of the bidder be accepted they will furnish the bond set forth in the Instructions to Bidders and the acceptance of the bid will be contingent upon the fulfillment of this requirement. The Borough reserves the right to increase or decrease quantities specified in the manner designated in the Specifications. The Borough reserves the right to award this contract based on funds available. Bidders are required to comply with the requirements of the Americans with Disabilities Act (N.J.S.A.10:5-31 et seq.) and with the disclosure provisions of N.J.S.A. 19:44A-20.13. The successful bidder shall be required to comply with the provisions of the New Jersey Prevailing Wage Act, Chapter 150 of the Laws of 1963, effective January 1, 1964. Bidders shall comply with N.J.S.A. 52:32-44 latest revision, regarding Business Registration with the New Jersey Division of Revenue. S:\Red Bank\Project Files\HRB00200.02 - East Side Park -Mohawk Pond Phase II\Specs\03- A 200-02.doc During the performance of this Contract, the Contractor agrees to comply with the requirements of P.L. 1975, c. 127 (N.J.A.C 17:27), and N.J.S.A 10:5-31 et seq., all requirements of the State of New Jersey Workers Health and Safety Act (N.J.A.C. 12:110 et seq.) as amended and the United States Occupational Safety and Health Act (OSHA)(29 CFR 1910), as amended with regard to worker and jobsite safety. No bidder may withdraw his bid for a period of sixty (60) days after the date set for the opening thereof. The successful bidder will be required to furnish a surety company bond in the full amount of the contract price indemnifying the Borough of Red Bank, New Jersey for all proceedings, suits or actions of any kind of description and conditional for the faithful performance of the work. The Borough Council of the Borough of Red Bank reserves the right to reject any or all bids if in its opinion it is in the best interest of the Borough to do so. GREEN ACRES PROGRAM: Please be advised that State funds through the Green Acres Program are being utilized in this project. Under N.J.A.C. 7:1-5, vendors currently suspended, debarred, or disqualified are excluded from participation on this project. By the order of the Borough of Red Bank. ($108.00)
