Site work, paving and renovation of a mixed-use development in Nome, Texas. Completed plans call for the renovation of a water / sewer project.

Bidders should visit the proposed project site to acquaint themselves with the site conditions prior to bidding on the project. For furnishing necessary materials, equipment, superintendence and labor for the City of Nome, Texas, Water Treatment Plant Rehabilitation Project, TWDB DWSRF Project No. 62820, generally described as the rehabilitation of the City's Water Treatment Plant is located on the east side of FM 365, approximately two miles south of US Highway 90. The WTP is bound by FM 365 (to the west) and the Lower Neches Valley Authority canal (to the south). The scope of work includes, but is not limited to, removal of debris from the filter backwash waste pond, excavation and capping of existing drain pipes from backwash pond and back filling hole, removal of debris and replacing of the damaged fence around WTP, replacement of air scour blowers used in the filter backwash process, relocation of turbidity meters and sensors, replacement of washed-out walkway and parking area, replacement of soil under concrete slabs due to washouts, removal of debris from the intake from LNVA to the WTP, removal of debris from holding ponds, stabilization of damaged berms, furnish and install concrete lab control building, replacement of sump pump in the filter gallery, and other appurtenances, as necessary. Bid Security, only in the form of: 1) a certified or cashier's check drawn on a Texas bank and made payable to the Hardin County Water Control & Improvement District No. 1; or 2) a bond executed by a surety company authorized to do business in Texas, in the amount of not less than five (5%) percent of the total bid, must accompany each bid at the time it is submitted. Bids must be submitted in duplicate. Bids may be held by the City of Nome, Texas for a period not to exceed 60 days from the date of the bid opening for the purpose of reviewing the bids and investigating the bidder's qualifications prior to the contract award. Time for receiving bids is subject to change pending review and approval of the plans and specifications by the Texas Water Development Board. This contract is contingent upon release of funds from the Texas Water Development Board (TWDB). Any contract or contracts awarded under this Invitation for Bids are expected to be funded in part by financial assistance from the TWDB. Neither the U.S. Environmental Protection Agency (EPA) or the State of Texas, nor any of its departments, agencies, or employees are or will be a party to this Invitation for Bids or any resulting contract. Any contract(s) awarded under this Invitation for Bids is/are subject to the American Iron and Steel (AIS) requirements of federal law, including federal appropriation acts. This contract is subject to the Environmental Protection Agency's (EPA) Disadvantaged Business Enterprise (DBE) Program, which includes EPA-approved fair share goals toward procurement of Minority and Women-owned Business Enterprise (M/WBE) businesses. Bidders on this work will be required to comply with the Department of Labor regulations at 41 CFR Part 60-4, relating to Construction Contractors--Affirmative Action Requirements, which include the President's Executive Order No. 11246, as amended by the Executive Order No. 11375 and Executive Order No. 13672, in the award and administration of contracts awarded under TWDB financial assistance agreements. Failure by the Contractor to carry out these requirements is a material breach, which may result in the termination of the awarded financial assistance. Attention is called to the fact that not less than, the federally determined prevailing (Davis-Bacon and Related Acts) wage rate, as contained in the contract documents, must be paid on this project. (a) All laborers and mechanics employed by contractors and subcontractors on projects funded directly by or assisted in whole or in part by and through the Clean Water State Revolving Fund or Drinking Water State Revolving Fund shall be paid wages at rates not less than those prevailing on projects of a character similar in the locality as determined by the Secretary of Labor in accordance with subchapter IV of chapter 31 of title 40, United States Code. (b) Pursuant to Reorganization Plan No. 14 and the Copeland Act, 40 U.S.C. 3145, the Department of Labor has issued regulations at 29 CFR parts 1, 3, and 5 to implement the Davis-Bacon and related Acts. Regulations in 29 CFR 5.5 instruct agencies concerning application of the standard Davis-Bacon contract clauses set forth in that section. All grants, cooperative agreements, and loans funded under the Clean Water State Revolving Fund and Drinking Water State Revolving Fund shall include the standard Davis-Bacon contract clauses found in 29 CFR 5.5(a), which shall also be incorporated in any resultant covered contracts that are in excess of $2,000 for construction, alteration or repair (including painting and decorating). The right is reserved by the City of Nome, as its interest may require, to accept or reject any or all bids, and to waive any informality in the bids received.
