Each bid must be accompanied by one of the following forms of bidder's security equal to at least ten percent (10%) of the bid amount: (1) cash; (2) a cashier's check made payable to the City of McFarland; (3) a certified check made payable to the City of McFarland; or (4) a bidder's bond signed by a surety insurer who is licensed in California, made payable to the City of McFarland. Each bidder must be a licensed contractor as required by law at the time the contract is awarded. The bidder who is awarded the project contract will be allowed pursuant to Public Contract Code Section 22300 to substitute securities for the payment of funds withheld under the contract. In addition, the successful bidder must furnish: (1) a faithful performance bond in the amount of one hundred percent (100%) of the contract price; and (2) a payment bond (also referred to as a labor and material bond) in the amount of one hundred percent (100%) of the contract price. All bonds must be in a form approved by the City of McFarland and must conform to California law (see Code of Civil Procedure section 995.010 et seq.). Inquiries or questions based on alleged patent ambiguity of the plans, specifications or estimate must be communicated as a bidder inquiry prior to bid opening.
