Park Place Audubon, IA 50025 A public hearing will be held by the City of Audubon, Iowa, on the proposed contract documents (plans, specifications, and form of contract) and estimated cost for the improvement at its meeting at 5:30 PM on October 11, 2021, in the Council Chambers at City Hall, 410 N. Park Place, Audubon, Iowa 50025, for the East Nishnabotna Dam Repair The City of Audubon, Iowa, reserves the right to reject any and all bids and to waive informalities and irregularities, and to enter into such contract as it shall deem to be in the best interest of the City. The work shall commence on the day indicated in the Notice to Proceed and shall be substantially completed on or before May 30, 2022 and completed and ready for final payment on or before June 15, 2022. Should the Contractor fail to complete the work in this timeframe, liquidated damages of $500 per calendar day will be assessed to the work not completed within the designated contract term. Each bidder shall accompany its bid with bid security as defined in Iowa Code Chapter 26, Section 26.8, and as specified by the City of Audubon, Iowa, in the amount fixed in the Instructions to Bidders. To the extent allowed by federal law and to the extent required by Iowa law, a resident bidder shall be allowed a preference as against a nonresident bidder from a state or foreign country if that state or foreign country gives or requires any preference to bidders from that state or foreign country, including but not limited to any preference to bidders, the imposition of any type of labor force preference or any other form of preferential treatment to bidders or laborers from that state or foreign country. In the instance of a resident labor force preference, a nonresident bidder shall apply the same resident labor force preference to a public improvement in this state as would be required in the construction of a public improvement by the state or foreign country in which the nonresident bidder is a resident. Failure to submit a fully completed Bidder Status Form with the Proposal may result in the Proposal being deemed nonresponsive and rejected. The general nature of the public improvement is Repairs to a sheet pile low head dam including grouted and loose rock revetment installation, site grading, tree removal, and other applicable work. The location of the public improvement is the City of Audubon Water Plant, 270 190th Street, Audubon, Iowa 50025. The successful bidder will be required to furnish bonds in an amount equal to one-hundred percent (100 percent) of the contract price, said bonds to be issued by a responsible surety approved by the City Council and shall guarantee the faithful performance of the contract and terms and conditions therein contained and shall guarantee the prompt payment for all materials and labor and protect and save harmless the Audubon from claims and damages of any kind caused by the operations of Contractor.
