Site work and new construction of a municipal facility in New Town, North Dakota. Working plans call for the construction of a 39,000-square-foot municipal facility; and for site work for a municipal facility.
The owner has selected a Construction Manager. REQUEST FOR QUALIFICATIONS SUBMITTAL INSTRUCTIONS CONSTRUCTION MANAGER AT RISK (CMAR) SERVICES EMERGENCY OPERATION CENTER AND THREE AFFILIATED TRIBES FIRE MANAGEMENT OPERATION CENTER NEW TOWN, NORTH DAKOTA 1. INTRODUCTION: The Three Affiliated Tribes (TAT) is in the process of building a facility for the Emergency Operations Center (EOC) and an Emergency Fire Management Center (EFMC). The EOC and EFMC will be responsible for mitigating disasters by implementing planning, education, operations, and the recovery of manmade or natural disasters that occur on the Fort Berthold Indian Reservation and the surrounding areas. The new facility will be located in Mountrail County on the Fort Berthold Indian Reservation in the City of New Town. The tribally owned property is 24.75 acres and referred asthe Wall Boy Subdivision Lot 3. The property is currently used for agricultural and the storage of hay. Currently, the project is in the schematic design phase and covers approximately 39,000 SF. A/E firm of record is EAPC Architects Engineers, 2080 36th Ave SW, Minot, ND, 701-839-4547. 2. SCOPE OF CMAR SERVICES: a. Estimating services of Construction Documents before bidding. b. Recommendations of savings. c. Complete a single phase project delivery, with a maximum total cost of $20 million which includes all construction costs, design and construction fees, owner costs, and FFE. 3. PROPOSAL FORMAT a. Paper Submittal: Submittals should not exceed 25 printed pages, excluding the front and back covers and section dividers, and shall be with a soft bound document using 8.5" x 11 "portrait" format paper. Eight paper copies shall be submitted. b. Electronic Submittal: One electronic format copy of the submittal shall be included in the submittal on a Compact Disk or USB drive. This copy shall be a non-editable PDF version of the paper copy. 4. SUBMITTAL REQUIREMENTS: The project will adhere to TERO guidelines for bidding and contractor selection. The TERO fee for contractors will not be waived. Please provide the following information: a. General experience of the firm. Please list examples of the firm's work for the past five (5) years, with the personnel responsible for the projects listed. List experience the firm has with Emergency Operations Center and Fire Management facilities. This experience will not be mandatory for selection but is preferred. b. Key personnel of contractor firm. The listing of personnel should include the Principal In- Charge, Project Manager, and on-site Superintendent. Please provide: 1) Each individual's educational background and experience 2) The length of service with the firm 3) Indicate availability of key personnel, workforce as it relates to project commitments and schedule. c. Contact person for the firm. Please list who we should contact for additional information or to arrange interviews as the need arises. d. Name three to five references. List the reference's title, addresses and telephone numbers, along with their relationship to either a particular project or how they are associated with the project. e. List all experience the firm has working with tribal governments. List all projects the firm has started and completed. f. Provide at least 4 similar projects and include the following information on each project that you have completed: 1) Budget/Construction Cost 2) Location 3) Square footage of the facility 4) Construction methods 5) Describe cost control methods used and how cost estimates were established. g. List the steps in your standard change order procedure. h. Insurance Liability Coverage: 1) Name of your general liability insurance coverage carrier and policy number 2) Name of insured 3) Policy limits of your professional liability insurance coverage. i. Project Schedule: The project is currently under preliminary design, it will be bid in 2022 for a construction start in spring 2022; projected Project Completion Date is no later than January 31 2023. j. Sub-Contractors: Services required from Sub-Contractors will be procured through a Competitive Bid Selection Process administrated and processed by the CMAR. TAT reserves the right to approve any and all Sub-Contractors. Criteria for selection of the CMAR based on Sub-Contractors, includes, but is not limited to the following: 1) The number and quality of Sub-Contractors the CMAR will obtain. 2) The ability to demonstrate a positive working relationship with local Sub-Contractors (or other construction related services) including references from key General, Mechanical and Electrical Contractors attesting to the ability of the CMAR to complete the project and coordinate the various aspects of the work. 3) Demonstrating an ability to forecast local bidding and construction conditions as it relates to sufficient work force and costs. 4) Open book bidding to be reviewed by the Owner. k. Fees: Provide a fee for Construction Manager At Risk that includes, but not limited to, the following items: Preconstruction services - Estimating - Owner and Architect Meetings - Value Management - Quality and Constructability Review - Front-End Specifications - Bidding and Procurement - Contract Requirements - Home office expenses - Accounting and In-house support - Profit and Overhead l. Self-Performance and Bidding: The CMaR will be allowed to self-perform, without bidding, no more than 5% of the total of all construction, 95% of the construction must be competitively bid through a public bid process as identified in NDCC 48- 01.2. m. Guaranteed Maximum Price: The Guaranteed Maximum Price (GMP) will be provided to the Owner after the review of the Construction Documents. The CMAR will be required to obtain bids and/or quantify costs for all work by February 2022. n. Savings on the Guaranteed Maximum Price: It is an expectation that the CMAR will make all effort to find savings within the project during the Construction Phase. Any savings on the GMP will be returned to the owner. o. Bonds and Insurance: Proof of ability to provide a bond in an amount at least equal to the amount of the Guaranteed Maximum Price of the project as well as meet necessary insurance requirements of the State of North Dakota. Note that the Mechanical and Electrical Contractor are to provide a separate bond for their work which may impact the cost and ability of obtaining a bond by CMaR. A letter from the CMaR's bond surety and commercial liability carrier stating any known claims, either pending, claimed or completed, in the previous 5years. p. Claims and Disputes: The firm's mission to be considered will agree to litigation as method of dispute resolution. 5. TIMELINE The following sequence of events is anticipated for the selection procedure of a Construction Manager at Risk: Shortlisting of CMAR Candidates November 12, 2021 Interviews with Select CMAR Candidates November 18, 2021 Select CMAR Services November 19, 2021 Project Completion by January 31 2023. NOTE: Submitting a Proposal indicates the Firm will be available for interviews on Thursday, November 18, 2021; Interviews will be conducted at the office of the MHA EOC: 603 1st ST N, New Town ND 58763 and will be approximately one hour in duration. It is expected by the Owner that the CMAR will have the project personnel in attendance. 6. SELECTION CRITERIA: a. A selection committee consisting of two or more Owner Representatives and the A/E firm Project Architect, will evaluate submittals. Selection will not be based on fee or pricing information. The Construction Manager at Risk will be awarded this project based on, but not limited to, the following scoring criteria: i. Demonstration of the qualifications contained herein- 10 points ii. Experience with similar projects - 20 points iii. Staff- 15 points 5- Experience (Similar) 5-Personnel Availability 5-Background/Skill Sets iv. Approach/Methodology- 30 points 15- Budget Control/Schedule Control 15- Process/Explanation/Application v. References- 15 points 0- Would not recommend or with limits 1- Reservations- 5 points 2- Recommend- 10 points 3- Highly recommend- 15 points 7. SPECIAL NOTE: This Request for Qualifications (RFQ) for a Construction Manager At Risk (CMAR) does not obligate the TAT to award a contract or complete the proposed projects. TAT reserves the right to cancel this RFQ if it is considered to be in its best interest. Proposals must be clear and concise. Proposals that are difficult to follow or that do not conform to the RFQ format or binding specifications may be rejected. Responding vendors must include the required information called for in this RFQ, TAT reserves the right to reject a proposal if required information is not provided or is not organized as directed. TAT also reserves the right to change any provision in this RFQ. Nothing in this RFQ obligates or commits TAT to any arrangement regarding the projects
