Demolition, site work and asbestos abatement for a residential development in Shamokin, Pennsylvania. Completed plans call for the demolition of a residential development; for site work for a residential development; and for asbestos abatement for a residential development.

The properties to be demolished hereunder is located in the City of Shamokin at 118 and 122 Independence Street in the City of Shamokin, Northumberland County. The Contractor will be responsible for obtaining and paying for any required permits. The Work comprises the demolition of all structures, sheds, other ancillary property structures, property restoration and all appurtenances for a complete job in accordance with the Contract Documents. 118 and 122 Independence Street have been declared unsafe to enter to complete the asbestos and lead testing. The facilities and building materials must be kept adequately wet at all times, starting with the demolition process, through site cleanup, transport and final disposal. "Adequately wet" means sufficiently wet to prevent the release of particulates and there are no visible emissions observed from any asbestos-containing material. If visible emissions are observed, the demolition must cease, and additional wetting must be performed until no emissions are occurring. However, the absence of visible emissions is not sufficient evidence of being adequately wet. For a complete discussion of the structurally unsound and in danger of imminent collapse provisions under the Asbestos NESHAP, please refer to 40 C.F.R. 61.141 and 61.145(a)(3), 61.145(c)(4) -(9). The Engineer's Certified Asbestos Inspector will be onsite during the demolition process. COMPLETION OF WORK: Time is of the essence. The Work must be substantially completed, signed, dated and approved on the Notice of Substantial Completion Form by the Engineer, Contractor and Owner within 60 calendar days after the commencement date stated in the Notice to Proceed. Liquidated damages will be assessed for each calendar day for failure of the Contractor to substantially complete the Work within the calendar days reserved for the Contract and/or for failure to sign and date the Notice of Substantial Completion Form. AWARD OF CONTRACT: (a) The Work hereunder is set forth in the Bid Schedule. The Owner reserves the right to award to the lowest responsive, responsible Bidder on Bid Schedule and reject all other Bids, as it may best serve the interest of the Owner. The Owner further reserves the right after opening Bids to reject any part or all Bids, to waive any minor informality, technical defects or irregularities in a Bid. (b) As a condition of award, the successful Bidder shall be required to submit Bonds, and Insurance, prior to execution of the Agreement by the Owner. Failure to meet this requirement shall constitute abandonment of the Bid by the Bidder and forfeiture of the Bid Bond or other security will be processed by the Owner. The Contract shall then be considered for award to the next lowest responsive, responsible Bidder. BID SECURITY: Each Bid shall be accompanied by a certified check, cashier's check, negotiable U. S. Government Bonds (at par value) or approved Bid Bond in the amount of 10 percent of the total Bid Price, payable to the City of Shamokin, as a guarantee that the Bidder, if its Bid is accepted, shall promptly obtain the required Bonds and Insurance and shall prepare the required submittal documents and execute the Agreement. A Bid Bond shall be secured by a guaranty or Surety Company listed in the latest issue of U. S. Treasury Circular 570 and the amount of the required bid security shall be less than the maximum specified for the guaranty or surety company in U.S. Treasury Circular 570. BIDS TO REMAIN OPEN: The Bidder shall guarantee the Total Bid and Total Bid Price for a period of 60 calendar days from the date of Bid opening or as allowed by law for the purpose of reviewing the Bids and investigating the qualifications of Bidders prior to awarding the Contract. The City of Shamokin reserves the right to reject any or all Bids, to waive any irregularities, or to negotiate the Contract amounts. CONTRACTOR LICENSE/PERMIT CLASSIFICATION: Each Contractor and Subcontractor is required to inquire of the Owner or the Municipality and purchase, obtain and maintain permits necessary to undertake the Work as part of the bid. The Contractor and Subcontractor are required to provide a copy of their Contractor's License issued by the Municipality where the Work is being completed and/or the Commonwealth of Pennsylvania. Failure to possess the specified license or permit shall render the Bid as non-responsive and shall act as a bar to award of the Contract to any Bidder not possessing said license or permit at the time of award. WAGE RATE REQUIREMENTS: A determination has been made by the Pennsylvania Department of Labor and Industry and/or Federal US Department of Labor for the Davis Bacon and Related Acts for each of the localities in which the Work is to be performed. Copies of these wage rate determinations are included herein. It shall be mandatory upon the Contractor to whom the Work is awarded and upon any Subcontractor under the Contractor to pay not less than wage determination specified rates to all workers employed by them in the execution of the Work, and the Contractor shall post a copy of wage determination specified rates at the Project Sites. RETAINAGE FROM PAYMENTS: The Owner shall retain a 10 percent payment due under the Contract Documents for all Work in place or materials stored on Site until 70 percent of the Work is in place at which time retainage may be considered for reduction to 5 percent if all change orders have been executed and proof of payment is submitted to the Owner showing that all subcontractors, suppliers and agency inspectors have been paid. All material must been paid for also. Reduction to 5 percent is not a mandatory requirement of the Owner. EXISTING REPORTS ON SUBSURFACE AND OTHER INVESTIGATIONS: No subsurface reports from the Owner and/or Engineer are available for this Project. The Contractor has the absolute right to conduct any subsurface investigations. If the Contractor conducts any intrusive subsurface investigation, the excavated area needs to be returned to pre-investigation condition with the installation of like materials removed and edge of excavation sealed. Failure of the Contractor to investigate any pre-bid subsurface conditions will fall solely on the Contractor, with no claim considered from the time of bidding through complete project closeout. EEO/WAGES/SALARIES: Attention is called to the fact that not less than the minimum salaries and wages as set forth in the Contract Documents must be paid on this Project; that the Contractor must ensure that employees and applicants for employment are not discriminated against because of their race, color, religion, sex, sexual orientation, gender identity, national origin, handicap or veteran status; and that, to the greatest extent feasible, opportunities for training and employment be given to lower income persons of the Project area and must, to the greatest extent feasible, utilize Project area businesses located in or owned in substantial part by Project area residents. In addition to the Equal Employment requirements of Executive Order 11246 regarding discrimination, the Contractor must also establish a 6.9% goal for female participation and a 1.0% goal for minority participation in his aggregate on-site construction workforce for Contracts in excess of $10,000. The City of Shamokin is utilizing federal funds for this project, and has adopted a Minority and Women Business Enterprise (MBE/WBE) plan in accordance with Executive Orders 11625, 12138, and 12432 and a Section 3 Action Plan in accordance with Title 24 Part 75 Code of Federal Regulations. As such, the Bidders must submit documentary evidence of minority and women business enterprises and Section 3 business concerns (which has changed from previous projects) who have been contacted and to whom commitments have been made. Documentation of such solicitations and commitments shall be submitted with the Bid. Moreover, the CONTRACTOR shall strive to meet the MBE goal of 5% and the WBE goal of 3% for contracts of $25,000 or more. For projects which the amount of HUD or CDBG funding exceeds $200,000 the CONTRACTOR must attempt to meet the minimum numerical goals of which 25% or more of the total number of labor hours worked by all workers on a Section 3 project are Section 3 workers, per 24 CFR Part 75.19; and 5% or more of the total number of labor hours worked by all workers on a Section 3 project are Targeted Section 3 workers, as defined in 24 CFR Part 75.21. The City of Shamokin in accordance with its Section 3 Action Plan, may provide a bid preference to a bidder who is a Section 3 business concern. MBE/WBE and Section 3 business concerns shall be afforded full opportunity to bid without discrimination. Davis-Bacon and Related Acts apply to this Project. Bids may be held by the City of Shamokin for up to 60 days from the date of opening for the purpose of reviewing the Bids and investigating the qualifications of Bidders prior to awarding the contract. The City of Shamokin reserves the right to reject any or all Bids, to waive any irregularities, or to negotiate contract amounts. CLARIFICATION DEADLINE 11/18/2021 3:00 PM
