The owner reserves the right to waive any informalities or to reject any or all bids. Each bidder must deposit with his bid, security in the amount, form and subject to the conditions provided in the Information for Bidders. All bidders must be licensed General Contractors as required by the Contractor's Licensing Act of 1994 of the General Assembly of the State of Tennessee, and qualified for the type of construction being bid upon. Attention of bidders is particularly called to the requirements as to conditions of employment to be observed and minimum wage rates to be paid under the contract, Section 3, Segregated Facility, Section 109 and E.O. 11246. No bidder may withdraw his bid within 60 days after the actual date of the opening thereof. Furnish and erect a glass-coated, bolted-steel water storage tank, including foundation, tank structure and tank appurtenances as shown on the contract drawings and described herein. All required labor, materials and equipment shall be included. This item shall consist of clearing, and/or grubbing, including the disposal of all materials, for all areas within the limits designated on the plans or as required by the Engineer. The work covered by this item shall consist of clearing and grubbing, (when not included as a separate pay item) loosening, loading, removing, and disposing in the specified manner of all wet or dry materials of whatever character, except rock, if any, which are necessary to be removed for construction purposed: grading of the site and/or roads; removing and replacing topsoil; furnishing, placing and maintaining all sheeting, shoring, bracing and timbering necessary for the proper protection of the work and the safety of the workmen and the public; backfilling and tamping of foundation and other structures; removal of same with suitable materials; and all other grading and excavation work incidental to or necessary for the construction of the work. Common excavation and backfilling of trenches for pipelines and appurtenances shall be performed in accordance with the requirements of this item, but shall be paid for as part of the work performed under individual Sections as applicable. Rock excavation wherever necessary shall be performed and paid for in accordance with the requirements of the Section entitled "Rock Excavation". Water and its removal and disposal are not considered excavation and are a responsibility to be assumed by the contractor and at the contractor's own expense. All material excavated shall be defined as "Unclassified Excavation" unless, in the proposal form, prices are asked and the bids taken for "Rock Excavation" and "Common Excavation". "Unclassified Excavation" shall include all excavation performed under this Section regardless of the material encountered. "Rock Excavation", when this classification is provided for in the proposal form, shall be as set forth in the Section entitled "Rock Excavation". "Common Excavation" when this classification is provided for in the proposal form, shall consist of all excavation not included in "Rock Excavation". Frozen condition of any of the different classified materials taken from excavation shall constitute no claim for higher classification or for extra work on the part of the customer.
