Scope of Work shall mean any Material and Services to be supplied under the specified scope unless the context requires a different meaning. The Scope of Work shall be available in the Contract Release and in accordance with Section 4 of the Agreement. (a) This Contract (including its attached exhibits), the Request for Proposal (RFP) including any clarifications issued by OPPD (if any) (the "RFP"), Contractor's Proposal, the Drawings and Specifications, performance, payment and other bonds required by this Contract, Special Conditions attached hereto, if any, and any issued Amendment collectively constitute the "Contract Documents". The Contract Documents are complementary, and what is required by one shall be as binding as if required by all; performance by Contractor shall be required to the extent consistent with the Contract Documents and reasonably inferable from them as being necessary to produce the intended results. (b) The Work is set forth in one or more mutually agreed upon contract releases, signed by both parties, each of which will incorporate the terms and conditions set forth in this Agreement (each, a "Release"). The Work and all materials shall be furnished and performed in strict accordance with the Contract Documents. (c) Should there be any conflict between any of the terms and provisions of the Contract Documents that cannot be reconciled, then the following priority shall prevail: (i) Amendments applicable to each Release, (ii) this Contract; (iii) Special Conditions; (iv) Drawings and Specifications attached to each Release; (v) performance, payment and other bonds required by the Release; (vi) the RFP applicable to each Release; and (vii) Contractor's Proposal. (d) Anything mentioned in the Specifications and not shown on the Drawings, or shown on the Drawings and not mentioned in the Specifications, shall be of like effect, as if shown or mentioned in both. In any case of difference in the figures, Drawings or Specifications, the matter shall be promptly submitted to OPPD for a written decision. Any adjustment by the Contractor without this determination shall be at its own risk and expense. (e) If the Contractor, in the course of the Work, finds any discrepancy between the Drawings and the physical conditions of the locality, or any errors or omissions in the Drawings, or deviations from applicable building codes and standards or in the layout as given by points and instructions, it shall be Contractor's duty to immediately (within twenty-four (24) hours) inform OPPD in writing of any discrepancy. Any Work done after such discovery, unless and until authorized by OPPD, will be done at the Contractor's risk and expense. (f) Where required hereunder, revised copies of the Drawings and Specifications pertinent to the Contract will be furnished by OPPD's Project Manager, and the Contractor shall maintain an up-todate, completely revised set of Drawings and Specifications on the job site. All Drawings, Specifications, modifications, Change Orders and other written materials pertaining to the Work are, and shall remain, the property of OPPD. The Contractor shall keep an accurate record of all deviations from the approved design Drawings and Specifications which may occur in the Work as actually constructed and shall submit to the Project Manager, through OPPD's Supply Chain Management Division, prior to request for final Contract payment, final as-built drawings.
