Materials shall be delivered to the Buyer within one-hundred and twenty-five (125) calendar days from receipt of fully executed agreement. Submittal Drawing and Specification Package shall be delivered by the Bidder to the Buyer within 14 Calendar Days from receipt of fully executed agreement. Within 20 Calendar Days after receipt of the submittal, the Buyer will respond with an action as indicated in City of Sacramento Standard Specification section 5-7. This project must be completed by a target date before the United States Army Corps of Engineers (USACE) implements improvements to the site. If the City's project is not completed before then, City will incur additional costs because it will have to redo improvements installed by the USACE. In light of that fact, Bidder recognizes that time is of the essence and that Buyer will suffer financial and other losses if Milestones are not achieved within the time specified. Therefore, Bidder agrees to pay Buyer $1500 in liquidated damages for each calendar day that expires after the time specified to offset the City's additional costs.
