It is expressly understood that bidders are responsible for getting the bid to the Municipal Clerk's Office by the time and date set for the bid opening. Bids shall be addressed to the Owner whose name appears in Paragraph 1(a) of the Instructions to Bidders; they shall be mailed or delivered to the address stated herein, enclosed in an opaque sealed envelope, clearly marked with the name of the bidder and the name of the project as described in this Notice to Bidders; and must be received by not later than the time designated in this Notice to Bidders. No responsibility will attach to Owner or Architect for premature opening of a bid which is not properly identified. Any bid received after 3:00 PM is late and will be returned unopened. Bidders are required to submit, in accordance with N.J.S.A. 40A:11-16(a)(2), one lump sum bid for all the work and materials. Bids must be accompanied by a certified check, bank cashier's check, treasurer's check or bid bond in the form provided in the bid documents, with corporate surety satisfactory to the Owner, in an amount of 10% of the base bid (but in no case in excess of $20,000.00 pursuant to N.J.S.A. 40A:11-21), naming as payee or obligee, as applicable, the City of Sea Isle City, to be retained and applied by the undersigned as provided in the bid documents in case the successful bidder defaults in executing the contract(s) or furnishing the bonds and insurance certificates as required by the bid documents. Prospective bidders are advised that this project is one which will be subject to and will be governed by provisions of New Jersey law, including, but not limited to, those regarding prevailing wage rates and certified payroll records (N.J.S.A. 34:11-56.25 et seq), use of domestic materials (N.J.S.A. 40A:11-18), and ownership disclosure certification (N.J.S.A. 52:25-24.2). The Public Works Contractor Registration Act (N.J.S.A. 34:11-56.48 et seq) requires that bidders must be registered at the time of bid. The Owner is requesting that copies of the certificates be included in bidders' submissions, but bidders must provide copies of the certificates no later than the time of award. Pursuant to N.J.S.A. 52:32-44 all business organizations that do business with a local contracting agency are required to be registered with the State of New Jersey and provide proof of their registration with the New Jersey Department of Treasury, Division of Revenue before the contracting agency may enter into a contract with the business. In addition, and pursuant to N.J.S.A. 40A:11-22, each bid must be accompanied by a certificate from a surety company stating it will provide said bidder with a bond in such sum as required by the above referenced statute. No bid may be withdrawn for a period of sixty days after the dates set for the opening thereof, except where permitted by law. The right is reserved to reject all bids pursuant to N.J.S.A. 40A:11-13.2, to waive minor informalities or non-material exceptions, and to take all actions necessary to protect the best interests of the City of Sea Isle City.
