The RFQ will be distributed to qualified small businesses, minority businesses and women's business enterprises, of which will be maintained on a solicitation list. Contract Term. This Contract shall commence upon the CITY's issuance of a Notice to Proceed, and shall be effective until the Contract is completed or terminated. Basis of Award. The CITY will make the Contract award, if any, to the Proposer submitting the Qualifications that is determined by the CITY, in its sole discretion, to be the most advantageous to the CITY, scoring criteria and other factors being considered, in accordance with its Procurement Rule: Flagler Beach Code of Ordinance, Chapter 2, Article IX, Purchasing Code which is incorporated herein by reference. The CITY reserves the right to waive any irregularity in any submission, to request clarification of any submission, to request additional information from any Proposer, to reject any or all Qualifications, in whole or in part, and to re-advertise, cancel, or postpone the solicitation, at any time, with or without cause, without liability to any Proposer. Minimum Requirements. Proposers must be in good standing and authorized to transact business in the State of Florida, and must not be listed in the System for Award Management (SAM) as an excluded party. In addition, all licenses required for Proposers whose businesses and professions are regulated by the Florida Department of Business and Professional Regulation must be active and current. Insurance. Specific professional liability insurance requirements are set forth in the Solicitation package. Cone of Silence. From the date of the initial publication of this Solicitation until Award, all communication (except for communications at the pre-proposal meeting(s) and site tour(s), if any) relating to this Solicitation, with the exception of Disadvantaged

Proposers are hereby notified that the CITY is subject to the Florida Public Records Law and the Government in the Sunshine Act, as set forth in Florida Statutes Chapters 119 and 286; as such, most communications to the CITY are subject to public disclosure, and the selection meeting(s), if any, will be open to the public.
