NOTICE INVITING BIDS DISTRICT LENNOX SCHOOL DISTRICT PROJECT DESCRIPTION LS DISTRICT SUMMER ROOFING PROJECT - BID NO. 02-01.25.22 LATEST TIME/DATE FOR 10:00 A.M. SUBMISSION OF BID Tuesday, January 25, 2022 PROPOSALS LOCATION FOR SUBMISSION OF BID PROPOSALS ONLINE; emailed to purchasing@lennoxk12.org BID AND CONTRACT DOCUMENTS AVAILABLE ON JANAURY 6, 2021 AT: www.lennox.k12.ca.us NOTICE IS HEREBY GIVEN that the LENNOX SCHOOL DISTRICT (District), acting by and through its Board of Education, will receive up to, but not later than the above-stated date and time, EMAILED Bid Proposals from Prequalified Bidders for the Contract for the Work generally described as LS DISTRICT SUMMER ROOFING PROJECT - BID NO. 02-01.25.22 1. Submittal of Bid Proposals. All bids shall be made and presented only on the forms presented by the District. Bids shall be received online at: PURCHASING@LENNOXK12.ORG and shall be opened and publicly read aloud via LIVE STREAMING. Any bids not received prior to the time specified above or after any extensions due to material changes shall be returned unopened. 2. Prequalification to Bid. As a condition of submitting a bid for this Project, and in accordance with California Public Contract Code section 20111.6, prospective bidders are required to submit to the District a completed set of prequalification documents on forms provided by the District available at www.lennox.k12.ca.us on the Facilities Department webpage under CUPCCAA. To prequalify you must submit a complete prequalification package no later than ten (10) business days prior to the bid opening. Bids will not be accepted if a Contractor has not been prequalified where prequalification is required. Contractors will be notified of their prequalification status within a reasonable period of time after submission of their prequalification documents, but not less than five business days prior to the bid opening date. 3. Documents Accompanying Bid Proposal. Each Bid Proposal shall be accompanied by: (a) Bid Security; (b) Subcontractors List; (c) Non-Collusion Declaration; (d) Certification of Contractor and Subcontractor(s) DIR Registration, and (e) Certification of Prevailing Wage & Related Labor Requirements. The Bidder acknowledges that if this Bid Proposal and the foregoing documents are not fully in compliance with applicable requirements set forth in the Call for Bids, the Instructions for Bidders and in each of the foregoing documents, the Bid Proposal may be rejected as non-responsive. 4. Bid Security. Each bidder's bid must be the original of one of the following forms of bidder's security and must be mailed or sent by express carrier so it is received before the bid deadline Tuesday, January 25, 2022 at 10:00 am by the LENNOX SCHOOL DISTRICT, Purchasing Department, at 10319 Firmona Ave, Lennox, CA 90304: (1) a cashier's check made payable to the District; (2) a certified check made payable to the District; or (3) a bidder's bond executed by a California admitted surety as defined in Code of Civil Procedure Section 995.120, made payable to the District in the form set forth in the Contract Documents. Such bidder's security must be in an amount not less than ten percent (10%) of the maximum amount of bid as a guarantee that the bidder will enter into the proposed Contract, if the same is awarded to such bidder, and will provide the required Performance and Payment Bonds, insurance certificates and any other required documents. In the event of failure to enter into said Contract or provide the necessary documents, said security will be forfeited. Failure of bidder to provide the District with an original bid security by the due date, will be deemed a non-responsive bidder and bid will be rejected. CONTRACTOR should consult the General Conditions, Supplementary Conditions, and General Requirements regarding Milestones and Liquidated Damages. 5. Job Walk. The District will conduct a Mandatory Pre-Bid Conference on Friday January 14, 2022 at 9:00 AM Sharp! Bidders are to meet at the front entrance of Buford Elementary School, 4919 W. 109th St, Lennox, CA 90304. One other site will be included in the pre-bid conference. All job walk attendees are required to wear face masks, and to practice social distancing during the Job Walk. 6. Contractors' License Classification. Each bidder shall be a licensed contractor pursuant to the California Business and Professions Code, and be licensed to perform the work called for in the Contract Documents. The successful bidder must possess a valid and active Class C39 Roofing License and a Garland Certified Installer As Applies to Scope of Work at the time of bid and throughout the duration of this Contract. The Contractor's California State License number shall be clearly stated on the bidder's proposal. 7. Bidder and Subcontractors DIR Registered Contractor Status. Each Bidder must be a DIR Registered Contractor when submitting a Bid Proposal. The Bid Proposal of a Bidder who is not a DIR Registered Contractor when the Bid Proposal is submitted will be rejected for non-responsiveness. All Subcontractors identified in a Bidder's Subcontractors' List must be DIR Registered contractors at the time the Bid Proposal is submitted. The foregoing notwithstanding, a Bid Proposal is not subject to rejection for non-responsiveness for listing Subcontractor the Subcontractors List who is/are not DIR Registered contractors if such Subcontractor(s) complete DIR Registration pursuant to Labor Code 1771.1(c)(1) or (2). Further, a Bid Proposal is not subject to rejection if the Bidder submitting the Bid Proposal listed any Subcontractor(s) who is/are not DIR Registered contractors and such Subcontractor(s) do not become DIR Registered pursuant to Labor Code 1771.1(c)(1) or (2), but the Bidder, if awarded the Contract, must request consent of the District to substitute a DIR Registered Subcontractor for the non-DIR Registered Subcontractor pursuant to Labor Code 1771.1(c)(3), without adjustment of the Contract Price or the Contract Time. 8. Prevailing Wage Rates. Pursuant to California Labor Code 1773, the Director of the Department of Industrial Relations of the State of California has determined the generally prevailing rates of wages in the locality in which the Work is to be performed. The Contractor awarded the Contract for the Work shall post a copy of all applicable prevailing wage rates for the Work at conspicuous locations at the Site of the Work. The Contractor and all Subcontractors performing any portion of the Work shall pay not less than the applicable prevailing wage rate for the classification of labor provide by their respective workers in execution of the Work. 9. No Withdrawal of Bid Proposals. Bid Proposals shall not be withdrawn by any Bidder for a period of ninety (90) days after the opening of Bid Proposals. During this time, all Bidders shall guarantee prices quoted in their respective Bid Proposals. 10. Waiver of Irregularities. The District reserves the right to reject any or all Bid Proposals or to waive any irregularities or informalities in any Bid Proposal or in the bidding. 11. Award of Contract. The Contract for the Work, if awarded, will be by action of the District's Board of Education to the responsible Bidder submitting the lowest priced response Bid Proposal. District further reserves the right to make multiple awards. If Alternate Bid items are included in the bidding, the lowest priced Bid Proposal will be determined on the basis of the Base Bid Proposal or on the Base Bid Proposal and the combination of Alternate Bid items selected in accordance with the applicable provisions of the Instruction for Bidders. Separate payment and performance bonds, each in an amount equal to 100% of the total Contract amount, are required, and shall be provided to the District prior to execution of the Contract and shall be in the form set forth in the Contract Documents. All bonds (Bid, Performance, and Payment) must be issued by a California admitted surety as defined in California Code of Civil Procedure section 995.120. Where applicable, bidders must meet the requirements set forth in Public Contract Code section 10115 et seq., Military and Veterans Code section 999 et seq. and California Code of Regulations, Title 2, Section 1896.60 et seq. regarding Disabled Veteran Business Enterprise ("DVBE") Programs. Forms are included in the Bid Package. Any request for substitutions pursuant to Public Contract Code section 3400 must be made at the time of Bid on the Substitution Request Form set forth in the Contract Documents and included with the bid. Any and all RFI's must be e-mailed to purchasing@lennoxk12.org titled RFP No. 02-01.25.22 by and no later than January 19, 2022. No telephone or facsimile machine will be available to bidders on the District premises at any time. It is each bidder's sole responsibility to ensure its bid is timely delivered and received at the location designated as specified above. Any bid received at the designated location after the scheduled closing time for receipt of bids shall be returned to the bidder unopened.
