Provide all labor and materials necessary to replace the kitchen grease interceptor for Truman Elementary School 9.11.1 If the Contractor refuses, neglects, or fails to complete the Work within the time stated at each Phase (or Substantial Completion Date) in the Contract, then the Contractor and the Contractor's surety, if any, shall be liable for and shall pay the Owner, not as penalty but as liquidated damages, the sum of Five Hundred dollars ($500.00) for each calendar day that the Contractor is in default after the time stipulated in the Contract for completing the Work of each Phase until the Work is Substantially Complete. The Owner may withhold from payments due the Contractor, such amounts as may be assessed as liquidated damages. Upon Substantial and Final Completion of the Work, the Owner may adjust the Contract Sum by the amount of the assessed liquidated damages. 9.11.2 For each consecutive calendar day that the Work remains incomplete after the date established for Final Completion, the Owner will retain from the compensation otherwise to be paid to the Contractor the sum of Five Hundred dollars ($500.00). This amount is the minimum measure of damages the Owner will sustain by failure of the Contractor to complete all remedial work, current deficient work, clean up the project, and other miscellaneous tasks as required to complete all work specified.
