Notice to Bidders Notice is hereby given that sealed proposals will be received by the City of Union City, Hudson County, New Jersey for the "2022 LANDSCAPE MAINTENANCE PROGRAM-A" and be opened and read in public at the City of Union City, City Hall, 3715 Palisade Avenue, Union City, New Jersey 07087, in the office of the City Clerk, on Thursday, February 10, 2022, at 11:00 AM. prevailing time and follow the COVID 19 - Supplemental Emergency Procurement Guidance as per the Local Finance Notice (LFN) 2020-10. This project consists of landscape maintenance at thirteen (13) locationseleven (11) parks, Musto Center, and the Central Avenue traffic islands in Union City. Maintenance shall include fertilization, soil building, hardwood red mulch, pruning, mowing, weed/insect/disease control, litter control and any other procedures outlined in the project specifications. In addition to maintenance, a lump sum allocation is established for the Bidder to install landscape improvements in some of the parks, if and where directed by the City of Union City. Landscape maintenance for this Contract shall begin no later than Friday, April 1, 2022 and shall be ongoing in eleven (11) parks, Public Properties and Central Avenue traffic islands until Saturday, November 19, 2022. Contract documents prepared by Colliers Engineering & Design, Inc., 400 Valley Road, Suite 304, Mt. Arlington, NJ 07856 (973-398-3110) are available electronically or via delivery by common carrier beginning on Thursday, January 13, 2022 by making an e-mail request to linda.boyer@colliersengineering.com, indicating "2022 Landscape Maintenance Program-A" in the Subject line. Bidders will be furnished with a copy of the Contract Documents by request upon proper notice to the above e-mail address. The bid proposal packages will not be available for pickup. In the e-mail message, the contractor shall indicate if they request an electronic copy (PDF format) or paper copy. Electronic copies will be provided via e-mail at no charge. Paper copies will be provided after a non-refundable charge of $50.00 payable to Colliers Engineering & Design, Inc. is received as well as the UPS or FedEx account information to defray the cost thereof. No Pre-Bid meeting will be held for this project. Proposals must be made on the standard Bid Form in the manner designated in the Contract documents, and must be enclosed in sealed envelopes bearing the name and address of the Bidder and the name of the project on the outside and be addressed to the City Clerk of Union City, and must be accompanied by a Statement of Consent of Surety from a surety company authorized to do business in the State of New Jersey and acceptable to the municipality, and either a Bid Bond or a Certified Check drawn to the order of City of Union City for not less than ten percent (10%) of the amount bid, except that the check shall not exceed $20,000.00. The successful bidder is hereby notified that a performance bond and payment bond for the full amount of this project and all labor is required. Contractor must submit within the same sealed bid envelope - 1 original proposal package and 2 complete copies of the bid package (clipped, not stapled). The award of the Contract for this project will not be made until the necessary funds have been provided by the City of Union City in a lawful manner. The Owner or the Engineer reserves the right to require a complete financial and experience statement from prospective bidders showing that they have satisfactorily completed work of the nature required before furnishing proposal forms or specifications, or before awarding the Contract. Proposals for this Contract will only be accepted from bidders who have properly qualified in accordance with the requirements of the Contract documents. The right is also reserved to reject any or all bids or to waive any informalities where such informality is not detrimental to the best interest of the Owner. Further, the Owner reserves the right to abandon the project and reject the bids entirely if any legal or state or federal administrative action is taken against the Owner which could delay or jeopardize the project from commencing. The right is also reserved to increase or decrease the quantities specified in the manner designated in the Specifications. The successful bidder shall be required to comply with the following: A. Affirmative Action requirements (P.L. 1975, c. 127, N.J.S.A. 10:5-31 et seq. and N.J.A.C. 17:27-1 et seq.); B. The provisions of the New Jersey Prevailing Wage Act (N.J.S.A. 34:11-56.25 et seq.); C. Anti-Kickback Regulations under Section 2 of the Act of June 13, 1934, known as the Copeland Act; D. Worker and Community Right-to-Know Act (N.J.S.A. 34:5A-1); and E. Anti-Drug/Alcohol plan in accordance with 49 CFR Parts 40, 199 and 391. The bid must be accompanied by a list of names and addresses of all stockholders owning 10% or more of the stock in accordance with the provisions of the Public Disclosure Law (P.L. 1988, C.33, N.J.S.A. 52:25-24.2).
