Renovation of a water / sewer project in Broken Arrow, Oklahoma. Completed plans call for the renovation of a water / sewer project.

Work includes removal of the existing concrete launder and replacement with a stainless steel launder. Contract time for the project shall be Two Hundred Fifty-Nine (259) calendar days. The Work consists of construction of Lynn Lane WWTP East Clarifier Rehabilitation, including removal of the existing concrete effluent launder, weir, baffle, and PVC chlorine distribution ring, and fabrication/ installation of a stainless steel effluent launder, PVC chlorine distribution ring, fiberglass weir, and fiberglass baffle, and incidentals for complete and usable facility. The work does not include modifications or rehabilitation to clarifier mechanism. The Work is located at the Lynn Lane WWTP, 13874 S 177th East Ave, Broken Arrow, OK 74013. Bidders on this work will be required to comply with the President's Executive Order No. 11246, as amended. The requirements for bidders and contractors under this order are explained in the specifications Sworn statement of the Bidder's assets and liabilities, technical qualifications and performance in the form of the latest annual report and financial statement are not required to be submitted with the Bidder's Proposal, but BAMA may require such statements prior to award of the construction contract. The Statement of Qualifications & Experience using the form found in Section II Proposal Documents, must be submitted with the bid and include, as a minimum, the information required herein. Failure to submit the information required in these documents may result in BAMA considering the Bid non-responsive and result in rejection of the Bid by BAMA. Bidders may be required to provide supplemental information if requested by BAMA to clarify, enhance or supplement the information provided in the Statement of Qualifications & Experience. The apparent successful Bidder shall, within two (2) days after Bid opening, submit to BAMA a list of the Subcontractors, Suppliers, individuals or entities proposed for the Work. Such list shall be accompanied by a Statement of Qualifications & Experience, using the forms found in Section II Proposal Documents, with pertinent information regarding similar projects and other evidence of qualification and experience for each such Subcontractor, Supplier, or other individual or entity. If BAMA or Engineer, after due investigation, has reasonable objection to any proposed Subcontractor, Supplier, individual, or entity, BAMA may, before the Notice of Award is given, request apparent successful Bidder to submit an acceptable substitute, within one (1) day of notification. If apparent Successful Bidder declines to make any such substitution, BAMA may award the Contract to the next lowest Bidder that proposes to use acceptable Subcontractors, Suppliers, or other individuals or entities. In such event, the next lowest Bidder shall, within two (2) days after requested by BAMA, submit to BAMA the above required list of the Subcontractors, Suppliers, and other individuals or entities. Bidders must demonstrate, at a minimum, at least three successful circular clarifier launder installations or rehabilitations that are similar in nature and scope to this project within the last five years. In evaluating whether a Bidder is responsible, BAMA will consider the qualifications and experience of the Bidder and may consider the qualifications and experience of Subcontractors and Suppliers proposed for those portions of the Work for which the identity of Subcontractors and Suppliers must be submitted as provided above. As a Proposal Guarantee, a certified check, cashier's check, bid bond or irrevocable letter of credit issued by an insured financial institution as required by law must accompany each Proposal for an amount equal to five percent (5%) of the total Bid made payable, without reserve, to BAMA. The successful Bidder must, within ten (10) days after receiving notice of award, furnish a Performance Bond, Statutory Bond and Maintenance Bond in the forms prescribed by BAMA in the amounts equal to the Contract price. BAMA reserves the right to reject any or all Bids. Project will be awarded to the responsible Bidder with the lowest base bid or lowest combined base and 1/19/22, 11:28 AM Convert Case | Convert upper case to lower case, lower case to upper case and more additive alternate bids, if any, which is most advantageous to BAMA. Applicable additive alternates, if any, will be determined at BAMA's discretion. The lowest responsible Bidder will be notified within ten (10) working days of the Bid opening as to when this Public Construction Contract will be placed on the BAMA Agenda for consideration. Each bidder shall accompany his bid with a sworn statement in writing that the bidder has not directly or indirectly entered into an agreement, expressed or implied, with any other bidder concerning the price or amount of such bid or any bids, the limiting of the bids or bidders, the paying to anyone any money for promotion expenses, the parceling or farmi the contract or any part of the subject matter of the bid or of the profits thereof. This project is to be financed by a CWSRF loan from the Oklahoma Water Resources Board (OWRB) and shall be referred to as Project No. ORF-21-0028-CWA. The following requirements and regulations must be complied with: A. Bidders on this work will be required to comply with the President's Executive Order No. 11246, as amended." B. "Each bidder must fully comply with the requirements, terms and conditions of the Environmental Protection Agency's Disadvantaged Business Enterprise Requirements including employing the six (6) good faith efforts and soliciting disadvantaged business enterprises during the performance of this contract. The bidder commits itself to following the good faith efforts to solicit disadvantaged business enterprises contained herein and all other requirements, terms and conditions of these bid conditions by submitting a properly signed bid. Requirements are contained in OWRB's Guidance and Procedures, ORF-267." C. "Davis Bacon Act wage rules shall apply. All laborers and mechanics employed by contractors and sub- - contractors on projects funded directly by or assisted in whole or in part by and through the Federal Government shall be paid wages at rates not less than those prevailing on projects of a character similar in the locality as determined by the Secretary of Labor in accordance with subchapter IV of Chapter 31 of Title 40, United States Code and 29 CFR parts 1,3, and 5. The Department of Labor provides all pertinent information related to compliance with labor standards, including prevailing wage rates and instructions for reporting. For more information, please refer to Oklahoma Water Resources Board Supplemental Conditions, ORF-185 as well as"American Iron and Steel provisions also apply to projects funded directly by or assisted in whole or in part by and through the Federal Government pursuant to P.L. 113-76, Consolidated Appropriations Act, 2014, Sec. 436 requires that "None of the funds made available by a State water pollution control revolving fund as authorized by title VI of the Federal Water Pollution Control Act (33 U.S.C. 1381 et seq.) or made available by a drinking water treatment revolving loan fund as authorized by section 1452 of the Safe Drinking Water Act (42 U.S.C. 300j-12) shall be used for a project for the construction, alteration, maintenance, or repair of a public water system or treatment works unless all of the iron and steel products used in the project are produced in the United States." "System for Award Management (SAM) registration is required for all SRF programs (CWSRF and DWSRF) applicants and Awardees (Entities, Prime Contractors, Subcontractors, Vendors) in order to be awarded contracts by the SRF rograms. SAM replaces Central Contractor Registration/Federal Agency Registration, Online Representations and Certifications Application, and Excluded Parties List System.
