This bid security must be produced in one or other of the following forms: a) a bond issued in favor of the PUBLIC BODY by a Financial Institution as defined in clause 0.01.14 hereof, which must be in accordance with the provisions of the model bid bond reproduced in Appendix 4.01A of the Bid Form; b) an irrevocable letter of guarantee issued in favor of the PUBLIC BODY by a Financial Institution as defined in clause 0.01.14 hereof, which must comply with the requirements of the "Irrevocable Letter of Guarantee" model reproduced in appendix 4.01B of the Bid Form. 4.01.02 Non-Legally Organized Consortium When the TENDERER takes the form of a Non-Legally Organized Consortium, the bid security must name each of the members of the Non-Legally Organized Consortium. 4.01.03 Maintenance The bid guarantee must be valid for the entire period of validity of the Bids. It also retains the bid guarantee of the second and third lowest compliant BIDDERS until the final award of the Contract to a CONTRACTOR. 4.01.04 Delivery The tender guarantee is delivered to the successful bidder in exchange for the performance guarantee required in section 4.02. 4.02 Guarantee of performance and obligations The TENDERER must attach to its Bid a letter of commitment signed by a guarantor guaranteeing the issue of a guarantee of performance and a guarantee of the obligations of the CONTRACTOR for wages, materials and services in accordance with requirements set out in part 4.00 of the Contract.
