All bids must be in accordance with the modernization specifications prepared by Walsh Associates, Ltd. The right to reject any or all bids is reserve A. Bids must be submitted in strict accordance with the specifications and on the bid forms provided herein. B. Submission of a bid will be considered presumptive evidence that the bidder is conversant with local conditions and facilities, requirements of the documents, pertinent state and local codes, state of material and labor markets, and has made due allowance in their bid for all contingencies. Should bidder's investigation of local codes or rules reveal stipulations contrary to the specifications, it should advise the elevator consultant without delay. C. Should a bidder find any discrepancies in, or omissions from, any of the specifications, or be in doubt as to its meaning, it should contact the elevator consultant. D. No oral explanation concerning the meaning of the specifications will be made and no oral instructions will be given before the award of a contract. Discrepancies, omissions or doubts as to the meaning of the specifications should be communicated to the consultant in writing at least 10 days prior to the date a bid is due to allow sufficient time for a reply before submission of bids. E. If a bidder desires to furnish an item different from that specifically mentioned in the specifications, it should immediately notify the elevator consultant of its intentions prior to the submission of the bid. Further, the bidder will supply the elevator consultant with information, data, pictures, cuts, etc., of the materials it desires to furnish to enable the elevator consultant to decide whether or not the article intended to be furnished by the bidder is in fact the equal of that specified. Any deviation from the specifications will be stated by the bidder as an exception to the specifications in a transmittal letter submitted together with, and as part of its bid.
