Provide duct cleaning services at the Los Angeles Community College District Educational Services Center All cleaning shall be in compliance with: The NADCA Standard (National Air Duct Cleaners Assn.) - Assessment, Cleaning, Restoration SMACNA Standards (Sheet Metal and Air Conditioning Contractors National Association) EPA Regulations (Environmental Protection Agency) OSHA/ Cal OSHA Regulations (Occupational Safety and Health Administration) Work to be performed at night. All work must be completed within TWENTY-FIVE (25) consecutive calendar days from the date stated in the Notice to Proceed. Said Notice shall not be issued prior to five (5) days after award of the contract, and shall not require that work be commenced less than five (5) days from the date of issuance of said Notice. Time is of the essence. Failure to complete the work within the time set forth herein will result in the imposition of liquidated damages for each day of delay, in the amount set forth in the Instruction s To Bidders. Each bidder agrees that, if its bid is accepted, it shall perform at least fifteen percent (15%) of the work, exclusive of supervisory and clerical work, without the services of any subcontractor. The bidder shall designate in its bid those portions of the contract constituting at least fifteen percent (15%) of the work bidder intends to perform without the services of any subcontractor. Each bidder must submit with each bid certified or cashiers check payable to the DISTRICT or a bid bond executed by an admitted surety insurer in the form set forth in the contract documents in an amount not less than 10% of the maximum amount of bid as a guarantee that the bidder, if its bid is accepted, shall promptly execute the Agreement, furnish a satisfactory Performance Bond in an amount not less than one hundred percent (100%) of the total bid price, furnish a satisfactory Payment Bond in an amount not less than one hundred percent (100%) of the total bid price, and furnish certificates evidencing that the required insurance is in effect in the amounts set forth in the General Conditions. The Bid Bond, Performance Bond, Payment Bond and Certificate(s) of Insurance must be on the forms provided in the Bid Package, failure to do so may result in a non-responsive bid. In the event of failure to enter into said contract and the required documents, such bid security shall be forfeited. Such security shall be applied toward, but shall not be considered a limitation upon any damage which may be sustained by the DISTRICT if the bidder fails to comply The DISTRICT reserves the right to reject any or all bids or to waive any irregularities or informalities in any bids or in the bidding. It shall be mandatory upon the CONTRACTOR to whom the contract is awarded, and upon any subcontractor under such CONTRACTOR, to pay not less than the said specified rates to all workers employed by them in the execution of the contract. All Bidders are hereby notified that the Los Angeles Community College District has a Project Labor Agreement (PLA) in effect and if applicable to the project all contractors and subcontractors bidding on the project will be required to comply with the PLA (if applicable). No bidder may withdraw any bid for a period of sixty (60) days after the set for the opening of the bids. The bidder may withdraw at any time before the time or submission of bids. A bidder who claims a mistake or forfeits his/her bid security shall be prohibited from participating in further bidding on the project on which the mistake was claimed or security forfeited. A bidder shall not be relieved of the bid unless by consent of the DISTRICT. If the bidder brings an action against the DISTRICT for recovery of the amount forfeited and fails to recover judgment, the bidder shall pay all costs incurred by the DISTRICT in the suit, including reasonable attorneys fees, to be fixed by the court. A payment bond and a performance bond will be required in the form set forth in the contract documents. Pursuant to Section 22300 of the Public Contract Code of the State of California, the contract will contain provisions permitting the successful bidder to substitute securities for any moneys withheld by the DISTRICT to ensure performance under the contract. Alternatively, the successful bidder may request and the DISTRICT shall make payment of retention earned directly to the escrow agent at the expense of the successful bidder.
