Tenders must be accompanied by (upon request originals of the below documents are to be provided by the Bidder to the Owner): - All tender forms as identified in the tender package, - Bid Bond, Certified Cheque, Letter of Credit or Money Order in the amount of 10% of the Tender Price, and - Consent of Surety for the required 50% Performance and 50% Labour & Materials Payment Bonds. As it is the purpose of the Owner to obtain the bid most suitable and most advantageous to the interests of the Owner, notwithstanding anything else contained within the tender documents, the Owner reserves the right, in his sole and unfettered discretion, to reject or accept any bid, including the right to reject all bids. In that event, all Bidders will be notified, and the Owner will not be liable to any Bidder. Non-compliant bidders will not be considered for this tender. Receipt and evaluation of a tender does not imply that the Bidder is compliant. However, The Owner reserves the right to accept the Tender deemed most favourable in the interest of the Owner. The successful Bidder shall be the Principal or Prime Contractor for the Project pursuant to the applicable construction safety legislation and shall have primary responsibility for the safety of all workers and equipment on the Project in accordance with such legislation. The successful Bidder must provide documentary evidence that they have achieved accreditation/recognition in a Safety Certification Program relevant to their industry and which is recognized by Alberta Labour, Occupational Health and Safety, or possess a Temporary Letter of Certification issued by Alberta Labour, Occupational Health within seven (7) days of being notified of the conditional acceptance of their tender, failing which their tender will be rejected.
